Number two is to consider and take appropriate action on a resolution to enter into a transportation project advanced funding agreement with the Texas department of transportation to construct the extension of howard lane to state highway 130 in northeast Travis County.
and what were you about to say about 2?

>> if we could, hold off on -- approve it, but hold off on the judge signing it until we get the signed road construction agreements.

>> I make the motion accordingly.
we'll approve it and we'll hold up until the judge signs, but we'll go ahead and move approval.

>> second.

>> what's the legal effect of that, mr.
gilmore?

>> I don't believe we have a final, enforceable agreement until it's signed.
we can approve it and sign it at a later date.

>> the reason I want to do that, Commissioners and judge, is the advanced funding agreement established that we are responsible for requiring the right-of-way.
they don't care how we get it, it's just our responsibility.
the road construction agreements acquire the right-of-way for us.
we don't want to admit ourselves to the advanced funding agreement until we know for sure we have the road agreements in place.
that's what it comes down to me.

>> any more discussion on number 2?

so do I have the original documents on number 2?

>> that is the advanced funding agreement.

>> do I have them?

>> we'll check.

>> I'm about to ask you to take them back if I do.
and at the appropriate time somebody will present them and I'll sign them.

i believe they're in your possession, judge.
we'll retrieve those for you and bring all three agreements to you at the same time through chris' office.

>> I'd like to thank you guys again.

>> judge Biscoe and members of the court, I really do want to express my appreciation to Commissioner Davis and the entire court, and obviously to steve and joe and chris and the county staff who has worked with us long and hard to get this done.
let me quickly say on the road construction agreement, we have in our possession signed agreements per the power of attorney that the schryvers had executed, and frankly, it's the same power of attorney they used to convey the right-of-way to txdot when the sh 130 was built.
we agree with chris that there's a question about the description of the property, so we're going the extra step of circulating the contract again to have it resigned individually by the members of the schryver family.
they're scattered all over, so it will take a little while to get them back in, but we have the signed document here per the power of attorney.
but this is just to do a cleaner version and make chris happy, so that's what we're trying to do.
the agreements are here and signed, I should quickly say.

stone and to the schryvers for their patience, possibly their snapping turtleishness, but I think that a mutual snapping turtleishness has produced a much better agreement overrule.

let me also -- I want to thank the county.
i hope the county appreciates that -- I worked on the very first extension of howard lane from i-35.
Commissioner Gomez remembers this.
to build howard lane on city and county property to get to the dell facilities that were opening up.
and it's -- and having worked on the sh 130 toll road for a number of years and getting that project started, for us to connect the busiest interstate in the nation, i-35, to the largest toll road project in the nation, to complete that link here in Travis County and connect that road in to east Austin, that's all about economic development and it's about this region's mobility.
and I really want to congratulate the court for getting to this point.
it's a great day for this region.
