>> don't be so happy when you say that is correct misporter.
this more than weigh started discussion of 36, the Texas department of transportation road project.
may require the relocation of certain county facilities.
we need to go into executive session with this under the consultation with attorney.
i have four or five legal questions I know.
and also the real property exception to the open meetings act.
37 is to consider and take appropriate action on purchase contract for approximately 3.5 acres of land from the Travis County community supervision and corrections division to secure smart facility enhancements.
consultation with attorney and real property exceptions.
and actually 37 is entwined with 36.
38, consider and take appropriate action regarding whether to file suit against pedro daniel to recover for damage to a county-owned guardrail.
consultation with attorney exception.
39, consider and take appropriate action regarding settlement offer from grimes county concerning payment of court costs associated with mental health services proceedings conducted in Travis County.
consultation with attorney.
40 and 41 we announced earlier would be postponed.
not discussed.
42, receive legal briefing and take appropriate action on statutory requirements under local government code 157.022 regarding treatment of overtime for certain peace officers.
consultation with attorney.
43, receive legal briefing and take appropriate action regarding new leases between Travis County and the Travis County health care district for county-owned clinics.
consultation with attorney and real estate exceptions to the open meetings act.
and because we postponed item 44, we postponed 45.
postponed 45.
44 is our last one and 44 is to receive legal briefing and take appropriate action regarding the mediation of claims by Karen steitle including settle offer in.
eoc charge number 31 c-2008-0140.
this will be under the consultation with attorney and personnel matters exceptions to the open meetings act.
we will discuss these in executive session but will return to open cart before taking any action.

>> we have returned from executive session where we discussed the following items, number 36 regarding the txdot expansion of 973, we did get our legal briefing and real estate briefing on that, in my view no action taken today, we will have it back on the court's agenda at the appropriate time in the future.
number 37 the matter involving the potential purchase of approximately 3.5 acres of land from the community supervision and corrections division, to secure a smart facility, move that we authorize staff to proceed with negotiations.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
38, is the matter involving a -- a possible lawsuit against pedro daniel to recover damage to a county-owned guardrail.
i move that we agree to settle this matter for $1,720.

>> second.

>> discussion?
all in favor?
show Commissioners Davis, Gomez, Huber and yours truly voting in favor.
Commissioner Eckhardt voting against.
and item no.
39 is the matter involving Travis County claim against grimes county concerning payment of court costs associated with the mental health proceeding that we conducted here in Travis County for them.
i move that we give in and settle for $500 and get this matter behind us.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
we did not discuss 40 and 41, we postponed both of those.
we did discuss number 42, though.
got an appropriate briefing for over time for certain peace officers after the county's population exceeds one million, in my view, no action today.
we will have it back on if necessary at some point in the future.
43, the matter involving a lease agreement with Texas health care district, we just need another week on this to mull over new language shared with us in executive session.
so we'll have it back on next week, I'll communicate that to the executive director of the health care district.
44 the matter involving Karen steitle, first let's thank Commissioner Huber for representing the Commissioners court at the mediation proceeding at the eeoc.
we need a week to mull over a proposed settlement and do additional work to see if we can deliver on part or all of the request.
and the request for Commissioner Huber, whether she wishes to continue working on this or whether she resigns and want the county judge to proceed.

>> I nominate the county judge

>> [laughter]

>> we'll do a little additional work on this item.

>> I'm happy to share.

>> yeah.

>> okay.
maybe we will work together then.
and we'll get it done between now and next week and hopefully have a report back to the court on it.
so no action other than that today.

>> move adjourn.

>> that will get it done for us.

>> motion to adjourn and second.
all in favor?
that passes by unanimous vote.
