Receive briefing from the county attorney and take appropriate action regarding outstanding obligation from kennedy ridge water supply corporation for utility relocation agreement. Consultation with attorney exception. 34. Receive legal briefing and take appropriate action regarding offer to settle claim against pedro daniel for damage to a county-owned guardrail. Consultation with attorney exception. 35. Receive briefing from the county attorney and take appropriate action regarding settlement offer from grimes county concerning payment of court costs associated with mental health services proceedings conducted in Travis County. Consultation with attorney exception. 36. Receive legal briefing and take appropriate action regarding the status of investigation of claims by Karen steitle, including the claims in eeoc charge no. 31c-2008-01470. Consultation with attorney and personnel matters exceptions. 37. Receive legal briefing and take appropriate action regarding the status of investigation of claims by chuck kelley, including the claims in eeoc charge no. 31c-2008-01436 and eeoc charge no. 450-2009-00943. That's the consultation with attorney and personnel matters exceptions. 38 a, receive legal briefing from county attorney on issues regarding confidential climate assessment received from employment practices solutions and take appropriate action; and b, deliberate results of confidential climate assessment in relation to executive manager of administrative operations; director of human resources management department (hrmd); and hrmd slot numbers 23, 16 and 9 and take appropriate action. Consultation with attorney -- both a and b are under the consultation with attorney and personnel matters exceptions to the open meetings act, we will not discuss 39, that's been postponed until next week. 40. Receive briefing from county attorney regarding Commissioners court's responsibility for providing collaboration, management or oversight of the Travis County housing authority. Consultation with attorney exception. Number 41. Consider and take appropriate action on purchase contract for approximately 3.5 acres of land from the Travis County community supervision and corrections division to secure smart facility enhancements. Consultation with attorney and real estate exceptions to the open meetings act. And our final executive session item today will be item no. 42. Receive briefing from county attorney and take appropriate action regarding issues related to novation of license agreement for operation of community center. We'll find out what novation means, also, I have forgotten it from my first year law class, john. Personnel matters and real estate matters exceptions to the open meetings act. We will discuss these matters in executive session, but will return to open court before taking any action.

we did suggest to staff to do more due diligence and recommend we have this back next week for action based on the responses that we received from leadership of the corporation.
and that's not a motion, just a recommendation where we seem to be leaning.

34 is the matter involving the damage to a county owned guardrail by pedro daniel.
we've been communicating with his insurance company.
I move we reject the counteroffer and reurge our offer.

next case, number 35, next item, involves an outstanding invoice that we sent to grimes county.
I move that we basically after negotiating this matter change our offer to $525.

we can either have the court approve what is actually sent and get you copies of what we're submitting before you would have to authorize it to be sent and then have someone sign it as an item on the agenda, or you could authorize someone to sign on behalf of the court at this point and then I would just take it to whoever is authorized to sign.

36 is the matter involving -- 36, 37 and 38, 36, I move that we ask our new Commissioner Karen huber to represent Travis County in the Karen steitle mediation before the eeoc and also in 37 ask ms. Huber to represent the Travis County Commissioners court and the claims filed by chuck kelly.
we understand from the eeoc that those two mediation matters will be dealt with on the same day.

38 is the climate assessment.

for those who have been following us on these three items, we promise to take action next week.
39 is a matter involving -- we did not discuss 39 and did not announce it.
that's the hamilton pool matter.
it will be back on next week just in case it's ready for action.
40, the matter involving the Travis County housing authority, we did receive our legal briefing.
that would be three or four additional specific questions for us to prepare written responses to the contractor share with the board, in my view, but no action required today and we'll have it back on at the appropriate time with those questions and requests for written responses.
41, the matter involving the approximately 3.5 acres of land that cscd wants to secure for a smart facility enhancements, I move that we authorize the signing of the purchase contract if it is returned to legal in substantially the same form that legal prepared and sent it over, and if there are significant changes that the matter be placed back on the court's agenda.

and number 42, the novation matter, we suggested the novation license agreement matter, we suggested to staff they contact the licensee at the precinct 3 community center and that we receive a report back next week with the intention of taking appropriate action based on the facts and the responses that we get.
