And I guess one other item before executive session, that must be number nine. Consider and take appropriate action on the following. A, amendment to terminate the advanced funding agreement for voluntary transportation improvement projects with the state of Texas for the permanent traffic improvements on our fm 2244 at loop 360 and b, termination of the indemnification agreement with palsades west llc to fund the permanent traffic improvements on rm 2244 at loop 360 in precinct 3. And why all of this termination now?
>> well, six months ago we entered into these agreements. We of course -- Travis County is nearly a pass through. There needed to be some improvements to 2244 to accommodate some development in that area. The developers were agreeable to putting up the funds to do it. We entered into a contract with this developer to receive the funds. We turned around and entered into a contract to pass the funds on to txdot. Txdot threw the benefit of good bid prices was able to get the work done well below their estimate, so no longer do we need the 300,000 that the developer put up. And -- but he agreed to enable those same funds to be used for other transportation projects and so he's willing to now give the funds to the mpo. For that to happen, we have to terminate both of these contracts to deobligate and then he can enter into a separate agreement with the mpo to pass the funds to the mpo for their use.
