Number 1 is a public hearing to receive comments regarding a total subdivision vacation in precinct 2, replat of lots 1 through 9, scarborough subdivision. 11 lots.

>> move that the public hearing be opened.

>> all in favor? That passes by unanimous vote.

>> good morning, Travis County t.n.r. This item is to vacate the nine lot subdivision and put in its place an 11 lot commercial subdivision. We did post signs on the site and this action has already been heard by zoning and platting commission. Our staff at t.n.r. Has not been contacted with any questions regarding this. And -- and it does meet our requirements.

>> okay. Have we taken the steps necessary to -- to take action today?

>> there wassing issue regarding -- we had -- we had set the public hearing for the 20th rather than the 21st. And -- and so the -- raises the question of whether we can take action today.

>> I have looked at that, at the notice requirements. The public hearing is something that -- that is not required by the rules or the -- or the -- or the statutes. It's something extra that -- that t.n.r. Does, but -- but I didn't look at the particular issue that it was noticed for the 20th and we didn't have it on the 20th?

>> in an abundance of caution would it be a setback for anyone involved if we were to take action a week from today?

>> I don't know that it would be. I'm sure that the applicant would like action to be towed. I would say that -- that I haven't heard any -- I -- we haven't had any calls or questions or complaints regarding this. Certainly if it were -- if it were controversial and we had any of those things I would, you know, have discussed that with the county attorney or -- I did talk to the county attorney's office on Friday about this and that -- their question for me was whether or not we had any opposition or, you know, if people had been asking about the items.

>> okay. One individual did call our office just for informational purposes, to my knowledge. Not -- not out of a desire to contest it.

>> and yesterday afternoon after I heard of that, I did follow up with our planners to see if they had called our office as well to get additional information and they had not.

>> why wouldn't we just take a week to be safe, I guess.

>> that's fine.

>> since we were not here yesterday. I mean --

>> okay.

>> okay.

>> so postpone the action one week?

>> okay.

>> back to the public hearing. Let's see what happens. Would anyone like to give comments during the public hearing in item no. 1? If so, please come forward.

>> move that the public hearing be closed.

>> second.

>> okay. All in favor? That passes by unanimous vote. We will postpone action on number 8 for one week just to be safe. Even when we post items for action if somebody appears and wants to give comments we would allow them to do so. Okay. So item no. 8 is postponed for one week. It will be back on the agenda next week.
