We have come to executive Session. The executive session items Are 17. Receive legal briefing And take appropriate action Regarding the status of Investigation of claims by Karen steitle, including the Claims in eeoc charge no. 31c-2008-01470. 18. Receive legal briefing And take appropriate action Regarding the status of Investigation of claims by Chuck kelley, including the Claims in eeoc charge no. 31c-2008-01436 and eeoc Charge no. 450-2009-00943. Consultation with attorney Exception, also. 19. Receive briefing from The county attorney and take Appropriate action regarding The pending litigation in Travis County, Texas and State of Texas vs. Coldwater Development ltd. And rodman Excavation, inc., et. Al. Consultation with attorney Exception. 20 a, receive legal briefing From county attorney on Issues regarding Confidential climate Assessment received from Employment practices Solutions and take Appropriate action, Consultation with attorney. 20 b, deliberate results of Confidential climate Assessment in relation to Executive manager of Administrative operations; Director of human resources Management department (hrmd); and hrmd slot Numbers 23, 16 and 9 and Take appropriate action. 20 b is under consultation With attorney exception, Also. And number 21. Receive legal briefing And take appropriate action On complaints regarding Austin police department Arrest review and travis County sheriff's office jail Conditions. Consultation with attorney Exception to the open Meetings act. We will discuss these Matters in executive session And -- but will return to Open court before taking any Action.


>> let's call back to order the voting session of the Travis County Commissioners court. We went into executive session this morning with five items. We discussed three of them. The two that we did not discuss are -- number 19, receive briefing from the county attorney and take appropriate action regarding the pending litigation in Travis County, Texas and state of Texas vs. Coldwater development ltd. And rodman excavation, inc., et. Al. That's under the consultation with attorney exception to the open meetings act. And number 21, receive legal briefing and take appropriate action on complaints regarding Austin police department arrest review and Travis County sheriff's office jail conditions. Consultation with attorney exception to the open meetings act, also, we will discuss only these two items in executive session but will return to open court before taking any action.


We have returned from executive session where we completed the discussions we started this morning.
and considering both discussions we included number 17, the matter involving the claims by Karen steitle in the eeoc charge.
there has been a request to ascertain the court's position on mediation.
I move that we agree to the requested mediation with the eeoc and that we indicate our intention to name a representative next Tuesday -- Wednesday, rather, so to that extent we need this back on the agenda.

this may be a good time to indicate that Monday is a county holiday.
Tuesday is inauguration day and so the court has decided to meet on Wednesday morning, January 21st instead of Tuesday, and hopefully we'll be able to get the meeting completed by noon, so that will give us three hours.
we also discussed number 18, the matter involving the claim from chuck kelly.
in my view no action required.
we'll have it back on the agenda next Wednesday in case we need it.

item number 19, the matter involving the lawsuit against cold water development, limited and rodman excavation, incorporated.
we did receive an update.
no action required today.
we will need a followup discussion next week and hopefully we'll have something to act on, but it will be back to court's agenda January 21, 2009.
same for 20 a and b.
we did have a full discussion this morning, underline full, and we'll have that one back on the agenda to discuss in connection with 17 and 18 next week also.

and we did get the update in 21 and I think sort of informally suggested that we respond to the letter that we got from the lawyer and share that with the Commissioners court and otherwise proceed to test the conditions complained of, and as soon as we've gotten results indicating findings and recommendations have it back on the court's agenda for appropriate action.
