and, all right, number 12 is approve modification number 31 to contract ma 980095, tiburon, inc, for extended services.

>> judge, the question I had for staff is that this particular upgrade, is this the final version of that upgrade?
I see that cef was kind of left out of the picture and I'm trying to figure out how did that happen and the upgrade that you are looking at, of course, 7.5 version.
but my question is how do they get left out and the amount of money that you are using here to fund that, is that money have already been set aside, which I understand it is coming out of your fund, but will you be coming back with the same amount of money later on because you don't have this particular money in -- because it's being used now?
could you answer that question for me?

I'll have to give you a little history to answer the question.
ces was added to the integrated justice system when we first brought it up.
it was not a prime product from tiburon so they developed it.
when we went to version 7 upgrade, they were not going to extend the life of that product.
we had hired a tiburon programmer who was going to develop it in house.
and so we were working on developing ces's application with i.t.
staff.
unfortunately she passed away.

>> she had the knowledge level to do that.
so we now need to include ces as part of the tiburon version 7 upgrade to ensure support.
since we don't have the tiburon knowledge in house any longer since her death.

>> okay.
all right.
I guess the question is since that person has passed on unfortunately, and extend sympathy, but since that has happened and we are still dealing with tiburon, what have we done in the meantime to make sure that we can address that issue in house if possible?

>> right.
we have got our development staff that they've got an application development cycle that is filled for the next 18 months.
we are going to have one of our business analysts work with tiburon as they develop this and will bring the knowledge of the application in house, and I would say since this version 7 should be a 5 to 7-year solution, ces should be getting a 5 to 7-year application, and we will hopefully begin to develop internally smaller applications like ces.
and we brought tropical depression that would allow us to -- bought products to allow us to integrate in-house.
however, the version 7 product for ces will be a product that has a life span that I think will be the same as version 7 for the rest of the public safety.

so this is just a one-time expenditure for this particular situation.

>> this particular application.

>> so it's not ongoing.

now, it won't last probably as long as you and I live.
I imagine that technology will change and needs will change and eventually the justice community may come back to you in 7, 10 years and ask for a different solution.

>> they will be asking somebody else.
I don't think they will be asking this Commissioner in 7 to 10 years.

>> I wanted to get clarification because I saw it and I was wondering why that happened and the way it happened and the amount of expenditures.
but you explained it and it wasn't explained that way in the backup so I just needed the explanation for that expenditure.
