Number 1 is a public hearing to receive comments regarding a request to authorize the filing of an instrument to vacate a 3.573 portion of a right-of-way originally dedicated for heatherwilde boulevard.

initially the 7.7 acres was dedicated by the original owner of those lands for heatherwilde.
since that time north town village, the village of north town bought most of the -- some 271 acres of land including this 7.7 dedicated land for the right-of-way.
since that time, campo has realigned the heatherwilde roadway.
as a result 3.5 acres, 7.35 acres is not needed so we're asking that there are portion of the 7.7 be vacated back to north town.

>> so as a general rule when we acquire right-of-ways for a particular project and that right-of-way turns out not to be needed, we typically vacate it which means it returns to the owners?
