>> unfortunately, we told the doctors who want to come on that item that we would call it up at 2:30. And they are not here, right? I suggest we go into executive session and come out. My office may want to notify them, it may be closer to 2:45 or 3:00. Before we get to item number 6. But it will be as close to 2:30 as possible. Item 32, receive briefing from county attorney and take appropriate action in first citizens bank and trust versus Travis County auditor. Consultation with attorney exception. 33, receive briefing from the county attorney and take appropriate action regarding pending litigation in Travis County and state of Texas versus cold water development limited and rodman excavation, consultation with attorney exception. 34, receive professorring and take appropriate action in reliable consultants bda dreamers and lerouge boutique versus ronnie earle. Consultation with attorney exception to the open meetings act. 35, receive briefing from county attorney and take appropriate action regarding an agreement between hartford casualty insurance company and Travis County Texas concerning fizz cal surety bond dated August 27, 2007, for construction of street and drainage improvements in cardinal hills estates unit 15 also known as mayor are villa subdivision. Consultation with attorney exception to the open meetings act. 36, receive briefing from county attorney and take appropriate action regarding settlement offer from grimes county concerning payment of court costs associated with mental health services proceedings conducted in Travis County. Consultation with attorney exception. 37, consider and take appropriate action regarding the potential purchase of real estate in central Austin, consultation with attorney and real estate exceptions to the open meetings act. 38, receive legal briefing on materials and conditions of contracts with star of Texas rodeo and take appropriate action. Consultation with attorney exception. 39, consider and take appropriate action on agreements related to the interlocal cooperation agreements with the city of Austin for public health services, central booking and emergency medical services. A, define renewal and amendment of the interlocal agreement with the city of Austin for public health services, and 39 b, regarding commitment to determine administrative costs to be charged under the above interlocal agreements. Consultation with attorney exception to the open meetings act. 40, receive briefing from county attorney by county, rather, and the county attorney regarding status of the license agreement with Texas disposal systems landfill, tds, and take appropriate action. Consultation with attorney on 40, john, let's also announce it under the real estate exception of the open meetings act. We previously announced our intention to postpone 41. And 42, our last item, consider and take appropriate action on a proposal to acquire open space parkland along onion creek near state highway 71 east with 2005 authorized bond funds in precinct 4. Consultation with attorney and real estate exceptions to the open meetings act. We'll discuss these cases, these items, rather, in executive session, but will return to open court before taking any action.

No action required today. We'll have it back on next week just in case. We also got a briefing on number 34, the reliable consultants dba dreamers and the boutique case. No action required today. We did get an appropriate briefing on that matter. 35, hartford casualty insurance company, I proof that we approve the proposed settlement agreement in this matter.

That passes by unanimous vote. 36, the matter involving the mental health services that Travis County has provided other counties and the invoices that we sent them. I move that we ask judge guy herman to chat with the county judge in grimes county about the invoice from Travis County to see if we can get them to voluntarily pay the invoice.

>> discussion? All in favor? That passes by unanimous vote. On number 37 we talked about two pieces of real estate in central Austin. On the first piece, I move that we get an appropriate appraisal, that facilities pay for that appraisal out of its lease payment line item.

>> discussion? All in favor? That passes by unanimous vote. The second part of this is that we authorize facilities staff to chat with the trustee of this property and share with the trustee the appraisal we have done and indicate the interest in purchasing this property.

>> discussion? All in favor? That passes by unanimous vote. 38, the matter involving star of Texas rodeo, I think we can generally just basically move that we keep negotiating with the other side. And we'll have it back on the court's agenda next week just in case we make progress.

>> seconded by Commissioner Davis. Discussion? All in favor? That passes by unanimous vote. Number 39, parts a and b, in a I move what we approve the proposed 2009 renewal and amendment of the interlocal with the city of Austin for public health services.

>> all in favor? That passes by unanimous vote. On b I move that we approve the proposed letter agreement with city of Austin, that we authorize the county judge to sign it on behalf of the Commissioners court.

>> all in favor? That passes by unanimous vote. Number 40, why don't we just instead of taking action indicate our intention to pull this item back up next year after we've had a new member of the court so we can try to resolve that matter if possible. We did not discuss 41. We indicated earlier that it would be postponed. 42, we did have returned to us an agreement that we basically approved last week and that agreement has been signed by the owner of this property. The owner of open space parkland along onion creek and I move that we approve the agreement and authorize the county judge to sign on behalf of the Commissioners court.

>> may I ask the court one thing? If possible, could the court authorize the executive manager to sign any documents necessary for the closing of that transaction if the county judge is not available to sign those documents?
