Now let's call back to order the voting session of the Travis County Commissioners court. We did begin our executive session discussions this morning. And -- and we need to go back, though, and finish those we did not get to. We did cover 28 and 29. We did not cover number 30. 30. Consider and take appropriate action on claim from william and luisa barlow regarding alleged damages to lot 75, cardinal hills estates, unit 15, maravilla subdivision. Consultation with attorney exception. We did discuss 31. Did not discuss 32, 32. Receive briefing from the county attorney and take appropriate action regarding the pending litigation in Travis County, Texas and state of Texas vs. Coldwater development ltd. And rodman excavation, inc., et. Al. That's the consultation with attorney exception to the open meetings act, also, we did discuss 33. Consultation with attorney exception and the real property exception to the open meetings act. 35. Receive briefing from county regarding status of the license agreement with Texas disposal systems landfill, inc. (tds) and take appropriate action. That's the consultation with attorney exception to the open meetings act. We did discuss number a 3.
>> purchasing -- that you will not need a 1. You need to pass that to next week.
>> all right, a 1 we do not need today, we will not discuss it and postpone it until next week instead. Our final item to discussion in executive session today will be number a 2.
>> actually, that needs to be in open court.
>> so we will announce that in open court. Now, questions regarding the legal significance of the --
>> there are no attorneys presented for that item today. So we -- we want to hear the presentation that john white has and then we'll go research those matters.
>> Travis County residents you heard that the same as i. We'll have an open court discussion. Then legal questions we'll deal with next week.
>> all right.
>> open court right now?
>> we could, if you want to. It's up to you.
>> now is as good of a time as any.
>> all right. Good afternoon.
>> hold on one second.
>> let's get Commissioner Daugherty back.
>> We previously announced several executive session items. Which we will now convene in executive session and discuss.
>> 33, 34, 35, is that right?
>> just need to make sure that I have the right people down here.
>> we have returned from executive session where we discussed following items. Number 28, the potential purchase of real estate in central Austin. Is there a motion on this one? Should we have it on next week for further consideration? Let's bring it back next week and mull over what we got today. 29 is the potential purchase of real estate along airport boulevard. I move that we authorize facilities to secure an appropriate appraisal and that the money to pay for the appraisal be taken from the lease budget in the facilities department.
>> second.
>> discussion? All in favor? That passes by unanimous vote. We discussed number 30, the matter involving william and luisa barlow. Is there a motion? 31 is a matter involving the star of Texas rodeo. Move that we continue negotiations. This is posted for us to receive a legal briefing, which we did get. There are three or four issues outstanding. My motion is that we authorize staff to continue negotiations and that we try to close the parts of the negotiations that we think we have resolved and that we present to the court next Tuesday appropriate documents for us to execute.
>> second.
>> discussion? All in favor? That passes by unanimous vote. Number 32 is a matter involving the lawsuit by Travis County and the state of Texas against coldwater development limited and rodman excavation. We did receive a briefing. In my view no action required today. We'll have it back on next week in case we need it. 33 is the matter regarding administrative costs with the city of Austin and interlocal agreements. We've already asked staff to notify the assistant city manager and the city manager of the county's position on the documents. It's probably a pretty good idea for the county judge to contact city manager, make sure that we emphasize the importance of taking action before the current extension expires. And the fact that in our view those documents are in their possession and we're awaiting delivery so we can respond appropriately. That's the motion.
>> second.
>> discussion? All in favor? That passes by unanimous vote. And we'll have it back on next week also. 34, the matter involving open space parkland along onion creek near state highway 71 east.
>> judge, I move that we instruct staff to move forward to the next steps that will lead to a contract that will come back to the court next Tuesday.
>> second.
>> and part of that too is to get the owners of the property to execute the draft document or the document?
>> okay.
>> and for us to look at it next week. Seconded by Commissioner Davis. Discussion? All in favor? That passes by unanimous vote. 35 is a matter involving our agreement with Texas disposal systems landfill inc. Regarding county own property in southwestern Travis County. We did discuss the need for a subcommittee of the court to put together a document that describes this court's expectations as to negotiations so we can make sure that we are on board as to next steps. We need two volunteers for that subcommittee.
>> judge, I don't know -- I'm happy to do that, but I don't know that I can -- that we can get it done before the end of the year.
>> on that draft document we can do a one or two pager and we can do it next Tuesday.
>> I'm happy to be part of that.
>> I'll look at that also, judge, with Commissioner Daugherty.
>> okay. Commissioner Daugherty and Davis.
>> with legal.
>> maybe we need to run that by john hilly.
>> for sure.
>> see if we can give them what they need. As to the subcommittee and the document, which I guess I can call a charge that sets forth negotiation with the owner of the property, put that in the form of a motion. Is there a second?
>> second.
>> discussion? We'll have it back on next week. All in favor? That passes by unanimous vote. We did not discuss a-1. We indicated our decision to postpone that based on a request from the purchasing agenda. A-2 we discussed in open court previously. A-3 we have a move that we appoint the subcommittee that has volunteered, Commissioners eckhardt and Gomez.
>> and myself, judge. And I guess by doing that --
>> a-3?
>> yeah, we need to post it, though, when we have a chance to for me.
>> and y'all won't be doing any work without a posted agenda. That's okay with you?
>> that's the only way we can make sure that the parties who have any interest in coming up with a good policy can all be together.
>> so we'll need to post it and meet in public, correct?
>> for a place where the public can come. That means they need to be accommodated, meaning chairs available.
>> it will be a large conference room.
>> yeah.
>> it does not have to be teleadvised.
>> the revolution will not be televised.
>> our goal is in two months to try to come up with appropriate criteria for financial incentives unless we decide not to. But either way we'll land up. All right. That's the motion.
>> second.
>> discussion? All in favor? That passes by unanimous vote. Ms. Porter that does it for today, doesn't it.
>> move adjourn.
>> all in favor? That passes by unanimous vote.
