Executive Session

I think that brings us to executive session. Let's announce item 15, consultation with attorney osteoporosis the open meetings act. 15, consider and take appropriate action to adjust allocation among expenditures approved in budget for fiscal year 2008 for which approval is extended in budget for fiscal year 2009 to make allocated maximums consistent with anticipated year-end actual balances and accruals. Consultation with attorney exception. Number 20, receive briefing from county attorney and take appropriate action concerning the extension of administrative leave with pay for human resources management department employee, slot number 2. Consultation with attorney and personnel matters exceptions to the open meetings act. 21, receive briefing from the county attorney and take appropriate action in Travis County et al. Versus doyle wilson home builder, inc. Nghia trong dau and lieu that's thi pmam restale deed. 22, consider and take appropriate action on the acquisition of land from park properties 1 and 2, lp and gdf realty investments in connection with the balcones canyonlands conservation plan. 23, receive briefing from county attorney in the valdez/nautilus case, consultation with attorney exception. 24, consider and take appropriate action regarding the potential purchase of really along airport boulevard. Consultation with attorney and real estate exceptions. 25, receive legal briefing and take appropriate action regarding contract from third party administration of Travis County section 457 deferred compensation plan with nationwide retirement solutions. Consultation with attorney exception. And number 26, receive status report and take appropriate action regarding issues related to contract between Travis County and Austin-Travis County livestock show and claims resulting from the 2008 star of Texas fair and rodeo. Consultation with attorney exception. We'll discuss these matters in executive session but will return to open court before taking any action.


Now let's call back to order the voting session of the Travis County Commissioners court. This morning we got through all of our agenda except for two executive session discussion items. Number 15, consider and take appropriate action to adjust allocation among expenditures approved in budget for fiscal year 2008 for which approval is extended in budget for fiscal year 2009 to make allocated maximums consistent with anticipated year end actual balances and accruals. We will take that one inin exception -- up in exception to get legal advice, so consultation with attorney exception. And number 25. Receive legal briefing and take appropriate action regarding contract for third party administration of Travis County section 457 deferred compensation plan with nationwide retirement solutions. That's the consultation with attorney exception to the open meetings act, also. We will only discuss these two items this time and we will return to open court before taking any action.

>> discussion? All in favor? That passes by unanimous vote. We did discussion item 21. The requested resale deed and move we authorize the county judge to prepare the resale deed by deeding the property in question to nighia trong dao, who have paid Travis County the sum of $10,600 in cash.

>> discussion? All in favor? That passes by unanimous vote. Item number 22 was the matter involving the park properties 1 and 2 and the gdf realty investments.

>> judge, I would make the motion that we authorize staff to obtain an addendum the county previously received to address the changes in the property boundary and market conditions with an effective date of August 1, 2008.

Show Commissioners eckhardt, Gomez, Daugherty and yours trawlly voting in favor, Commissioner Davis -- that passes by unanimous vote. 23, the matter involving the ophelia malicia claim. We did get an update. No action required today and they will let us know when to put it back on. 24, the matter involving the potential purchase of real estate along airport boulevard, we did discuss that matter, asked some questions and the staff is supposed to do additional followup under the real estate exception. We'll have that matter back on in two weeks. So that will be October 28th of '08. Any other action required on that action item? 25, we discussed at length with legal counsel. We'll have that matter back on the court's agenda next week for followup action. 25, yeah --

>> yeah, move that we did review a letter that legal staff has prepared for our review, one we should send to nationwide retirement systems. Move that we approve this letter, sign it and authorize that it be sent to mr. Riebel asap and we indicate the county judge will speak to him on behalf of the Commissioners court on Thursday of this week or as soon thereafter as possible.

>> probably e-mail or fax it, right?

>> actually I was thinking we would initially fax it and then I would send an original --

>> got a paper clip? That's fine since we're headed toward the clerk after this. Is that okay?

>> that's number 25. Number 26, the matter involving a counter to the counteroffer to settle in the matter involving the livestock association and the star of Texas fair and rodeo, we'll have that item back on the court's agenda. We did ask staff to do additional followup work for us so it will be the court's agenda next week for consideration and action. Anything else needed on that item today? 26? We'll have it back on next week. And we discussed item number 15, the matter involving the budget for fiscal year 2008 expenditures and the extended budget for fiscal year 2009, and to make the encumbrances consist it to be reflected in the '09 budget or as close as possible. And we have been presented a proposed order that amends a budge that's we previously approved for the year ending September 30th, 2009, and this order does exactly what we needed it to do. And do we need to hear anything further? Okay. Move that we approve the order.
