4. Receive comments regarding a request to authorize the filing of an instrument to vacate a twenty-two square foot portion of a public utility easement located along the northwest lot line of lot 295 of apache shores, 1st installment, a subdivision in precinct three

>> move that the public hearing be opened.

>> all in favor? That passes by unanimous vote.

>> in this case, the owner already constructed the home and encroached on the easement by 22 feet. Which will mess up any sale of the house if he tries to go sell it. So he's asking that the 22-foot portion of the public utility easement be vacated and the utilities have no issue with that. So we would recommend the vacation to allow the title to be cleared.

>> no objections called to our attention?

>> no. Not that we know of. This is really just an issue of the ability to sell the home because it now encroaches on an easement.

>> how did we find that out, joe?

>> he probably tried to sell the home.

>> I mean if he's trying to sell the home, that's the reason that we are finding out now --

>> to get it cleared up.

>> that he needs to get --

>> right.

>> 22 feet. 22 square feet.

>> 22 square feet.

>> 22 square foot. It's -- yeah.
