Executive Session

Let's take into executive session the matter we just discussed. Number 23, lot 75, maravilla subdivision. 33, receive legal briefing and take appropriate action and notice of claim filed by dan armstrong, tracy evanson john hardesty, mike coweden. Robert hawkins regarding an area at the Travis County jail. This is an exception to the open meetings act also. 34, receive legal briefing and take legal action regarding the Travis County assessor nelda spears and comptroller of public accounts regarding motor sales and use taxes paid to the court on nsf checks for the period of January 1, 1997, through December 31, 2005. As reflected in the comptroller's decision in case number fleven 474 consultation with attorney. We will take 35. That is -- will not take 35. 36 is to take land from the comanche trail fund in connection with the balcones conservation land plan. Conservation with the attorney and real estate exceptions to the open meetings act. 37 receive legal briefing and take appropriate action regarding the pending litigation in the state of Texas of cold water development limited. And number 38, receive legal briefing and take appropriate action regarding 30 party administration of Travis County. Deferred compensation plan with nationwide solutions and nationwide application of it. With exception to the open meetings act. We will discuss those matters in executive session and return to court before making any action.

>> I'm sorry, 23, cardinal hills estates, unit 15, mara v subdivision. Move that we authorize the -- mr. Hang smith, engineer, to complete the drainage work that he started quite some time ago, that the county pick up the cost of these services, up to $30,000, that the source of funding be the rich management fund, if available and appropriate, with a secondary source being the general fund allocated for reserve. That we get with the bonding company and try to get them to move more expeditiously to address the concerns, and that we prepare a status report to share with the family that was here today advising us of this problem, that we indicate to them as best we can the schedule that we think we are on, careful to cite the many conditions and circumstances beyond our control.

>> that was kind of long but I think if we get the spirit of it captured that would be good. Discussion? All in favor. That passes by a yu unanimous involve vote. Item 33 involves the review area. Move that we authorize the county judge to notify the city of Austin chief of police that Travis County is working on relocating the arrest review area and we think that in a matter of days we should have the appropriate computer connections for him to relocate and that we have this matter on the court's agenda more generally worded in the future to give us an opportunity to give status reports and take appropriate action as necessary.

>> any discussion? All in favor? That passes by a unanimous vote. No. 34 is the matter involving a controversy we have going with the state of Texas comp. Patrollers. I move that we authorize the county attorney to represent Travis County and nelda wells spears tax assessor and the district court of travis to seek a judicial review of the comptroller's -- in 47472 involving a funds adjustment for credit request of money paid by Travis County to the comptroller for insufficient funds check received from motor vehicle sales, taxpayers that we have this matter back on the court's agenda next Tuesday just in case we want to consider it further.

>> just quickly, I'm going to vote in favor of this, but I'm voting in favor of it to preserve all of our -- all of our legal options. I still have a fact question that -- that goes to the legal issues I'm going to get answered before next week.

>> okay. Any more discussion? All in favor? That passes by unanimous vote. We did not discuss 35 or 36. We'll have both of those back on the agenda next week. 36, we're waiting on the contract, is why we did not discuss it. Hopefully we'll have it next week. 37 we discussed. That's the hamilton pool matter, and my view, no action required today, and legal will let us know when they have it back on. We basically encourage our lawyers and county representatives to keep working with all of the parties in this matter, hopefully to get it to a satisfactory conclusion. We did not discuss 38 either. We were told at the last minute that the county attorney had pulled this matter. We'll have it back on next week just in case we need it. We have no further business today, colleagues.
