Executive Session

Are we to executive session? Let's try to get discussion. 30, receive briefing from county attorney and take appropriate action regarding settlement offer in the valdez/nautilus case. Consultation with attorney exception to the open meetings act. Back to number 17, a legal briefing on that one. 17, consider and take appropriate action -- 17, let me see. We had revised wording on that for the legal briefing. No action. But it's to receive legal briefing on request for a development permit for the b.f.i. Sunset farms landfill site at 10200 giles lane. This is consultation with attorney also. And 31, receive briefing from the county attorney and take appropriate action regarding the pending litigation in Travis County, Texas, and versus coldwater development limited and rodman excavation. Consultation with attorney exception to the open meetings act. 33, consider and take appropriate action on April 18, 2008 grievance panel's decision regarding human resources management department, rrmd, employee slot number 7 to implement panel recommendations, including counseling and mediation recommendations and on conducting a climate review of hrmd. This is under the personnel matters and consultation with attorney exception. 34 is to receive legal briefing and take appropriate action regarding claims by charles kelly including claims made in eeoc charge number 31 c-2008-01436 c. That's the consultation with attorney exception to the open meetings act. And let's go to 36, receive legal briefing and take appropriate action regarding claims by Karen steitle including claims made in eeoc charge number 31 c-2008-01470. I have not announced 32 or 35, but let's try to get as much done on the others as possible.

Now let's call back to order the voting session of the Travis County Commissioners court. This morning we started executive session and covered a full two items which leaves us covering several that has been in my possession since we recessed the executive session. We discussed 17 and 30. 31, receive briefing from the county attorney and take appropriate action regarding the pending litigation in Travis County and state of Texas versus coldwater development and rodman excavation. Consultation with attorney exception. 32, receive legal briefing regarding budgeted and compensation fund for departments headed by certain appointed officials. Consultation with attorney. 33, take appropriate action on April 18, 2008 grievance panel's discussion employee slot number 7 to implement the panel's recommendations including counseling and mediation recommendations and on conducting a climate review of hrmd. Personnel matters and consultation with attorney exceptions. 30, receive legal briefing and take appropriate action regarding claims by charles kelly including claims made in eeoc charge number 31 c-2008-01436 c. Consultation with attorney exception to the open meetings act. 35, receive briefing from county attorney and take appropriate action concerning the extension of assistive leave with pay for human resources employee, slot number 2. Personnel matters and consultation with attorney exceptions to the open meetings act. And our final executive session item today is number 36, receive legal briefing and take appropriate action regarding claims by Karen steitle including claims made in eeoc charge number 31 c 2008-01470. Consultation with attorney exception to the open meetings act.

Commissioner Daugherty you volunteer to be representative at the mediation?

>> mediation is scheduled four separate days. Move that we approve the demand letter from the county attorney to the defendants in this case. And that the -- the figures set forth as the hamilton pool costs and damages break down be incorporated in that -- into that demand letter.

>> discussion? All in favor? That passes by unanimous vote. We did get plenty of legal advice on item no. 32, in my view, no action required today. Number 33 the matter involving employee slot number 7, move that we -- that we -- basically direct that we do an investigation and climate assessment. In that matter. If we get -- that we get it done as soon as possible, so we authorize staff to obligate the -- the appropriate finances in order to get this accomplished. There was a list of -- of potential firms and persons provided us, let's simply authorize staff to get with the county attorney and administrative operations to select that list and the appropriate firm to carry out this work.

>> discussion? All in favor? That passes by unanimous vote. And number 35 request for administrative leave with pay for human resources employee, slot number 2. Move that we authorize an additional five days. That we have this matter on the court's agenda again next week just in case we need it.

>> all in favor? That passes by unanimous vote. There is a separate posting that was supposed to take place at 2:00 or following adjournment or recess of the Travis County Commissioners court. It is a grievance hearing. I understand that it's been requested for executive session. The county judge must recuse himself as he has been a fact witness in this matter. So -- so we leave it to the rest of the court to have fun.
