Let's call to order the Travis County housing finance corporation, three items. The first of which is, one, to consider and take appropriate action on request from Austin children's shelter for assistance in the construction of a new campus on the mueller airport site.

>> good afternoon, I'm harvey Davis, manager of the corporation. And the amount of the request is $250,000. And let me review very quickly the funds that in my opinion are available for this request and other requests. Over the next two years, from both corporations, I estimate that there's $405,000 available. And in your backup, I've listed the entities that have submitted capital requests. The total of unfunded -- in other words, requests that are still being considered, which this one is one, total is $726,233.

>> how much money do we have available in '09?

>> we have -- in '09 we have -- in 10 we have 180,000. So in '09 225,000. Yeah, '09, 225.

>> my own view is we ought to use that money to deal with health and human services needs, try to address some of their requests that the department brought forth. And I think we ought to like to declare a moratorium on most capital contributions for the next couple of years until we see what the economy does. The reason I put it that way is in addition to being that responsive to this one, I think we ought to tell the others who make requests, and there are some, that we're kind of out of money this year, and he really are. But there's a long list of health and human services requests that I think we ought to try to meet, and based on the revenue projections I've seen, if we don't fund them this way, they'll go unfunded. And the other thing is if nothing else we really ought to have basic needs money set aside just in case. That's my own view.

>> I think we've done a good job of assisting with capital projects, especially in the last five or six years. But we did have a steady flow of funds into the corporations, and the economy was in pretty good shape, so we could use the general fund to meet human services needs.

>> and the steady flow is -- will be less steady because seton fees will end in November of 2010. So we have two more payments of the seton fees.

>> judge, I was going to have to abstain on this one anyway because of a relationship. So I won't be able to vote on it anyway.

>> then I move that we express appreciation to them for sending it to us and just tell them basically that we are kind of out of money in the corporations, and that we have decided for this year especially not to provide any assistance to capital projects because there is none. And we would have to look at next year's budget to figure out what we do in 2010.

>> second. But the other thing is we can say we have needs that might go unfunded in terms of basic needs.

>> yeah, health and human services. Let's draft an appropriate letter like that. Can it go out over the president's signature? Something that's kind after standard that maybe we can use for the rest of the year.

>> okay. There are four entities that have requests in for capital projects, and I will draft a letter for you to consider signing.

>> I see six on the summary of special service agency capital requests, just as a point of clarification.

>> yeah. There are five -- it's not four, it's five. One has already been aprafd. It's on the list.

>> meals meals?

>> that's meals on wheels, but that's already been approved. That was is is done in the spring.

>> any that we have approved we would want to keep our commitment and honor our commitment.

>> but it's the other five listed.

>> all right. Seconded by Commissioner Gomez. Any further discussion of the motion? All in favor? Show board members eckhardt, Gomez and yours truly voting in favor. Commissioner Davis abstaining. Number two is to consider and take appropriate action on request to approve invoice for legal services rendered and expenses incurred.

>> the amount of the invoice is $295.15, and this is the final invoice for the lakeview i.r.s. Examination, which I'm happy to report is no change. And your backup is the no change letter we received from the internal revenue service. And this would be the last invoice from ms. Bowed, who represented the corporation.

>> based the assurances that this will be the last invoice from this firm for that work, I move approval.

>> second.

>> just 30 minutes' worth of work. That was great.

>> no. This is the second invoice.

>> tell that lawyer we still have some sense of humor down here, mr. Davis.

>> okay.

>> discussion? All in favor? That passes by unanimous vote. Number 3 is to consider and take appropriate action on request to send an invoice to american agape foundation in connection with the internal revenue service examination of the lakeview apartment bonds.

>> and I'm requesting your permission to send an invoice for $7,500. I can't say that we will be able to collect on the invoice. The american agape foundation was the sponsoring nonprofit for the lakeview bonds. The entity that owns the bonds was a subsidiary. Agape Austin area housing. They went into bankruptcy when thes were foreclosed on, and would be normally the entity that would pay such a fee. But I have consulted with our attorney regarding sending this fee, it's certainly appropriate to send it, and they certainly should pay it because this saved them perhaps a lot of trouble.

>> that's why I move approval.

>> second.

>> discussion? All in favor? That passes by unanimous vote.

>> we don't know what will fall from the tree unless we shake it, right, mr. Davis?

>> that was my thinking, yes.
