Executive Session

>> this morning we discussed item no. 20 involving the third party administrator of deferred compensation plan and recommendations and is barbara wilson nearby. We indicated that we may have one or two questions for herment and, two items in executive session. We did postpone this morning number 30 and 31. 32. Receive briefing from the county attorney and take appropriate action regarding the pending litigation in Travis County, Texas and state of Texas vs. Coldwater development, ltd. And rodman excavation, inc. Et al. 1 33. Consider and take appropriate action on a proposed first amendment to contract for the existing improved property commercial contract between Travis County and balcones resources, inc. For the sale of property located on johnny morris road, in precinct 1. That's the consultation with attorney. Consultation with attorney on both. And real property exceptions to the open meetings act. By the way, number 20 would be consultation with attorney exception. We will be in executive session hopefully about 10 minutes, we plan to come back to open court, adjourn the voting session, call to order another voting session that includes both firms. Okay? Thank you for your patience, we have moved speedily today, although it may not appear that we have.


>> we have returned from executive session where we discussed the following three items. Number 20 we did get advice of counsel. Just to clarify the previous motion, we expect staff to put together a -- a sort of simple english summary for county employees to look at, understand issues before us and if they can put together a simple side by side comparison of what we're dealing with, we think that will be beneficial also. Our motion was intended to -- to authorize staff to -- to do what's appropriate to notify all county employees of the issues that we will be looking at next Tuesday. And if there's no objection to that, we will simply consider that to be part of the previous motion.

>> okay. We did not discuss 31 and 30. We did discuss 32. The matter involving hamilton pool. We'll have that back on the court's agenda next week for appropriate action. 33 we did discuss that matter, involves county owned property on johnny morris road in precinct 1.

>> judge, I move that we aloe balcones resources until -- until October the 6th of 2008 to allow them to do the necessary due diligence and also if -- if necessary allow our county staff this -- the -- the -- the county attorney's office and anybody else that -- that may be necessary to -- to allow for this -- for the assistance if needed.
