Executive Session

If stacy's not here, I think we need to take up executive session. Let's get the other lawyers. We are about to go into executive session. 29 is to receive legal briefing from the county attorney and take appropriate action regarding request to attorney general number rq-0664-ga from comal county, density of development issues. Consultation with attorney exception. Note this I skipped number 28, and that's because the county attorney asked that we postpone 28 until next week. So we will not discuss it. 30, receive legal briefing regarding budget and compensation funding for departments headed by certain appointed officials. May need that briefing, may not. He'll announce -- we'll announce it anyway. Consultation with attorney. 31, discuss and take appropriate action on available lease space in central downtown area. That's the real property exception to the open meetings act. 32, receive briefing from the county attorney and take appropriate action in Travis County et al versus jack e.stults junior and tommyestults, raul gonzalez retail deed. 33, receive briefing from the county attorney and take appropriate action in Travis County et al versus federal deposit insurance corporation. 34, consider and take appropriate action on an offer to sell a .160-acre easement from a and j leasing llc to Travis County needed for construction of the gattis school roadway improvement project as part of the 2005 bond program in precinct two. 35, consider and take appropriate action on offer to sell a .275-acre drainage easement and temporary construction easement from thomas cardwell and cynthia webber to Travis County needed for construction of the howard lane east roadway improvement project as part of the 2005 bond program in precinct 1. Number 38, receive briefing from the county attorney an take appropriate action regarding the pending lit dpaition in Travis County, Texas and state of Texas versus cold water development limited andman excavation incorporated et al, consultation with attorney. We previously indicated our intention to call up item no. 10 in executive session. And 10 is consider and take appropriate action on request to increase the hourly contribution by the Travis County sheriff and constables for use of county owned vehicles while performing off duty work. Consultation with attorney exception to the open meetings act. We will discuss as many of these as possible between now and 12 noon, but will return to open court before taking any action.

Consultation with attorney exception to the open meetings act. We'll discuss these items in executive session, but return to open court before taking any action.


>> we have returned from executive session. Commissioner Gomez had to run to another commitment and will miss the rest of this meeting. But we discussed number 10 involving the contribution by the Travis County sheriff and constables for the use of county owned vehicles while performing off-duty work. There was a representation that 20 bucks an hour this morning. We do have some testimony that $15 an hour for some constables may be more appropriate. Is there a motion?

>> yeah. Judge, I move that we go with the recommendation that was made by pbo of $20. As opposed to the 15.

>> I'll second it.

>> seconded by Commissioner Daugherty. Discussion? All in favor of that motion? Show Commissioners Davis, eckhardt, Daugherty voting in favor. County judge abstaining. We discussed number 29 dealing with the comal county request for an ag opinion. In my view no action required today. And we'll have this back on in the future when it's time to take up action. Number 30 we did get a legal briefing from the county attorney on funding for departments not headed by the Commissioners court. Move that we authorize the county judge to have a follow-up discussion with the county auditor, and if necessary the district judges regarding some concerns that we have.

>> discussion? All in favor. That passes by unanimous vote. 31, we did discuss with staff the opportunity to lease certain space in the downtown area. And my motion is that we authorize the county judge and/or Commissioner Daugherty to have a follow-up conversation with the property owner about the rate, the amount of space available and other relevant issues that we discussed.

>> discussion? Favor? That passes unanimously and also to express our deep appreciation for the property owner's willingness to work with us. Number 32 is a matter involving the tax retail deed to raul gonzalez. I move that we authorize the county judge to sign the prepared tax resale deed to raul gonzalez who has paid Travis County the sum of $10,000 in cash.

And number 33, I move that we authorize the county judge to sign the prepared tax resale deed to eric gonzalez, who has paid Travis County the sum of $3,130..31 in cash. Any discussion? All in favor? That passes by unanimous vote. 34 is a matter involving .0160 acres of land that we need for an easement on the gattis school road improvement project. Got a motion, Commissioner Davis? Do you want me to may one? Do you want me to make the motion?

>> okay. Move that we accept the offer to sell this tract of land to Travis County for the sum of $5,000.

>> any discussion? All in favor? That passes by unanimous vote. And I called Commissioner Davis on it instead of Commissioner eckhardt.

>> [ laughter ] that's why I wanted to let you make, but I can make this this one here.

>> 35 is to sell to Travis County .2 survive acres of land that we need for an drainage easement on the howard lane east project.

>> judge, I move that we pay the sum of $25,000 for .275 acres for the purpose of drainage easement and also a temporary construction easement to thomas cardwell and cynthia webber and this is for the howard lane one road project.

>> any discussion? All in favor? That passes by unanimous vote. 36 is a matter involving the bfi landfill expansion request. I move that we authorize the sum of $10,000 in the transportation and natural resources budget from allocated reserve in order to cover expenses to proceed with this matter.

>> discussion? All in favor? That passes by unanimous vote. 37 is a matter involving waste management of Texas, inc. Landfill, and its expansion application. Move that we authorize the sum of $15,000 to be taken from allocated reserve and placed in the transportation and natural resources budget to be used to cover expenses in this matter, including consultants necessary.

>> any discussion? All in favor? That passes by unanimous vote. And also on 36 and 37, those amounts are intended to get us through the end of this fiscal year, and sometime during the budget process we need to take a look at it and probably the early part of next year do a similar transfer into tnr to meet '09 expenses for both of these. We expect the waste management matter to cost substantially more than bfi because of the nature of the contest. 38 is a matter involving Travis County and the state of Texas against coldwater development limited and rodman excavation. We did get an update. And we'll have this matter back on the court's agenda next Tuesday. And hopefully at that time we'll be ready to give staff directions on how to proceed. No action required on that item otherwise, is that correct? Did we miss anything? We are done with our work today.
