Number 27, consider and take appropriate action -- by the way, after this one we'll call up the preliminary budget. 27 is to consider and take action on the the following. A, request to use 2005 bond unallocated project funds or 1997 or 2001 bond fund savings from completed precinct 1 projects to acquire right-of-way for the realignment of fm 3177 in precinct 1. And b, advance funding agreement for voluntary local government contributions to transportation improvement projects with no required match for the fm 3177 and braker lane 1 project in precinct 1.

>> good morning, judge and Commissioners. This is a follow-up to an agenda item from last week. At that time we had indicate that had we needed to have a conversation with bond counsel, the county attorney's office and pbo to verify what sorts of funds we should use for this realignment of fm 3177, which is a part of the braker lane 2005 project. At that meeting we all agreed that it would be an appropriate use of 2005 tier 1 braker lane bond funds to acquire the right-of-way for this realignment of fm 3177. We don't have to go to some alternative source. We can use what was approved by the voters for the braker lane tier 1 project.

>> so the unallocated project funds from the 2005 bonds would be the appropriate source for the funding.

>> no, sir. We looked at four pots of money. One is bond money that was approved by voters in 2005, specifically for braker lane tier 1 projects.

>> exactly.

>> that money is okay to use to acquire this right-of-way. We do not have to look at unallocated project funds or 97 funds or 2001 ones funds. We're okay with what the voters approved. Soirks the funds from 1997 and 2001 --

>> we do not have to use unallocated project money. We can use what the voters approved for the tier 1 braker lane project.

>> judge, I -- I would like to move approval of 27 a and b with the caveat that 'txdot is still under -- in this advanced funding agreement, txdot is still going to do the design and also the construction, is that correct?

>> that's true, Commissioner. I think it would be best if the court would state that we are going to use these monies to acquire that right-of-way just so there's no misunderstanding we go to start spending money.

>> that's part of the motion then.

>> and it does commit txdot to commit the design and pay for the construction and commit to us to acquire the right-of-way.

>> second.

>> okay. So the first part of this motion really is to use the 2005 bond funds to do this project.

>> 2005 tier 1 braker lane bond funds to acquire the right-of-way for the realignment of 3177.

>> there's enough money there?

>> yes, sir.

>> okay. What's the second part of it?

>> to approve the advanced funding agreement with txdot, which commits them to complete the design and the construction at their cost, commits us to acquire the right-of-way at our cost.

>> and they've agreed to do this?

>> yes, they have.

>> any more discussion? All in favor? That passes by unanimous vote.
