Travis County Commissioners Court
July 22, 2008
Executive Session
23, consider and take appropriate action on license agreement with Texas disposal system for use of county land on ranch to market road 620, former county solid waste transfer station, and we simply note that this may be taken into executive session under the consultation with attorney exception to the open meetings act. And I can almost assure us that we need to do that because this is the sort of contract issue we probably have legal questions about.
>> I think that is the way to handle this thing to -- since there are a number of things that we do need to keep in executive session. And then after that then if we want to lay something out, I really anticipate that we probably, you know, wouldment to come back and revisit this. I know Commissioner eckhardt is going to be out this week and next week.
>> this week and next week.
>> so, you know, obviously, I mean, we need to move forward on this thing, but I think once we get some of the issues discussed in executive session, it may kind of dry out where we will go proposal-wise.
>> so we think we need to go in there first?
>> we definitely do.
>> okay. Then I just announced under the consultation with attorney exception to the open meetings act. While we're in there, we may as well discuss the next three items, only remaining items and that is 31, consider and take appropriate action on purchase of land from the comanche trail conservation fund and joseph lucas in connection with the balance conies plan. That will be under the real estate exception. Let's also announce 31 under consultation with attorney. 32, receive legal briefing on county authority to approve the Travis County health care district's budget. Consultation with attorney. And 33, receive briefing from county attorney and take appropriate action and/or consider settlement offer regarding gregory ealy, file number 245.806. Consultation with attorney exception to the open meetings act. We'll discuss these in executive session but we'll return to open court for further discussion and any action.
we are back from executive session where we discussed items 23, the matter involving Texas disposal systems and the contract with Travis County. We got a briefing probably --
>> back on the 5th of August, judge.
>> we'll have it book for the fifth of August for appropriate discussion and appropriate action. We discussed number 31, the matter involving the joseph p. Lucas tract in connection with the balcones canyon land conservation plan. We received the briefing, urged the parties to keep working and I guess they'll let us know when to put it back on. We discussed item 32, the matter involving the health care district and had legal issues clarified for us by the county attorney. In my view no action required today. This matter will be back, the purchase of real estate, at some point in the future. 33 is the matter involving a claim from gregory ealey, file number 245-806. I move that we reject the counteroffer -- not the offer, but to counter in the amount of $10,000, with the understanding that that would cover personal injuries, medical expenses and associated -- and claims associated with the dog bite, but not the property claim, which another governmental entity should be consulted about.
>> second.
>> discussion? All in favor? That passes by unanimous vote. The other thing about 33 is that we would issue an appropriate letter of apology in addition to the financial counteroffer.
>> were they expecting a release or something our office would prepare?
>> our typical settlement and release.
>> and they bring it back to you to sign off on it?
>> I wasn't really thinking this would flow that quick withly, john. Are you accepting the other side to accept the counter? If they do, bring that document for us. We'll move it quickly. That does it for today.
>> move adjourn.
>> second.
>> all in favor? That passes by unanimous vote.
