Number 2 is a public hearing to receive comments regarding requests to authorize the filing of instruments to reject the dedication and quitclaim deed of a 0.78 acre unnamed right of way dedicated by document number 2007152762 across lot 1 of the dessau point subdivision, in precinct 2.

>> in the original development, there was a -- this piece of land was dedicated as -- by a separate instrument as right-of-way. At the same time, there was a separate instrument that had already dedicated a private 25-foot easement for -- for wastewater line. And now -- now they are trying to take that one lot and subdivide it into four -- replat it into four commercial lots. Well, typically, we would not have a private easement under a right-of-way, so this first action basically is to reject the dedication. The county never accepted the right-of-way, there's no road there. And in its place will become a joint use easement. So the -- the 25-foot utility easement can remain there. It will still have the -- basically the same footprint as would have been provided with the right-of-way that we're fixing to vacate. It will have access to the four proposed lots. But it will be a private easement. The county will not actually maintain any road or accept any road as a result of this. So the first between in this two step process is to reject the dedication of the right-of-way. That was

Anybody here to testify during this public hearing before we close it? All in favor? That passes by unanimous vote. This will be action item no. 17 on today's agenda.
