21 is consider and take appropriate action on request for variance to install a supply and return line to the treatment units closer than 5 feet to the house foundation at 2909 pamela court. We want to call this up. The question is what do we do to protect the county in situations such as this. Let's say we grant the variance and something happens to this home or homes downstream of this in the future, what kind of indemnification or liability waiver can we get from this property owner?

>> stacy shuffle, t.n.r. The property owner has given us cart blank indemnify qaition and with waived all the liability that may go along with grant ing this variance.

>> and if this homeowner does something to impact another homeowner, for example, downstream, this homeowner takes responsibility for it?

>> yes, but that's highly unlikely. The seth backs are closer to their own foundation than to somebody else's.

>> with that I move approval.

>> second.

>> mr. Geiselman.

>> that's fine.

>> any more discussion? We've done this one before and we sort of get boxed in on these, don't we?

>> in this memo we gave you some sense on what occasions we bring a variance forward. You've seen them three times in a row and we thought let's explain a little about the process and why we bring them to the court and under what criteria we would judge whether it warrants a variance or not. In one particular case there really was no option for this homeowner than to get the variance.

>> do we need to address that in some sort of policy in the future?

>> might be.

>> that way we can make sure --

>> all right.

>> okay. All in favor? That passes by unanimous vote.
