This morning we announced we would take item 20 up in executive session for a brief legal briefing from the assistant county attorney barbara wilson. 20 is a matter involving the officials salaries for next year. 30. Consider and take appropriate action on purchase of land from the comanche trail conservation fund and joseph f. Lucas in connection with the balcones canyonlands conservation plan. That's the real estate real property exception, let's also add consultation with attorney. 31. Consider and take appropriate action on purchase contract with parke properties I and ii, l.p. And gdf realty investments ltd. For the acquisition of land in connection with the balcones canyonlands conservation plan. 2 real property and consultation with attorney exceptions. This morning we announced our intention to postpone items 32 and 33 until next week, so we will not discuss them. 34. Receive briefing from county attorney and outside counsel, renea hicks, esq. Regarding decision in northwest Austin m.u.d. V. Michael b. Mukasey in the u.s. District court for the district of columbia. Consultation with attorney. 35. Receive briefing from county attorney and take appropriate action in Travis County, et al v. John m. Devereaux, jr. And sharon jensen (cne real property, llc resale deed). 1 consultation with attorney. 36. Receive briefing from county attorney and take appropriate action in Travis County, et al v. Jack h. And mary h. Vaughn (cne real property, llc resale deed). Consultation with attorney. 37. Receive briefing from county attorney and take appropriate action in Travis County, et al v. The hamlets corporation (lindaura dasilva resale deed). Consultation with attorney. 38. Consider and take appropriate action regarding the security committee's recommendations for the fiscal year 2009 budget process. That's the security exception to the open meetings act. We already discussed item 39 this morning. We won't need it this afternoon. A 3 -- nope, a 2 is receive legal briefing from county attorney and take appropriate action regarding the contested case hearing on the pending application for the proposed solid waste amendment to expand waste management of Texas landfill located on giles road near state highway 290 east. This is the consultation with attorney exception to the open meetings act. And item a4. Receive legal briefing from county attorney on whether state law authorizing the creation of the Travis County healthcare district, or any other law, prohibits Travis County from spending public funds on health or mental health issues. That's the consultation with attorney exception to the open meetings act, also. We will discuss these matters in executive session.

we have returned from executive session where we discussed the following items: we discussed number 20 with legal, got a briefing and legal is working on a memo that we can share with our judges and hopefully that will be ready. We need this item back on next week. So if we could try to get it to the judges on maybe Friday of this week, it will help. Okay. Any other action ready on that one?

>> number 30, got a motion you've got?

>> judge, subject to price being worked out, I would recommend that the county make two offers i, one on the whole, that being the 341-acre tract. The offer would be 36.5 million. Or the whole minus roughly 50 acres for a price of 28.6 million. And that the court offer would be good for 30 days. That would be my motion.

>> I have 28.6.

>> I’ve got 28.6 too. Roughly 290 acres.

>> roughly 290 acres would be the whole minus the 50 acres.

>> second? Discussion? All in favor? That passes by unanimous vote. We discussed number 31 involving the park properties 1 and 2 lp, and gdf realty investments limited and agreed basically to mull over our discussion and come back in and have a follow-up discussion next week. So that item will be back on the agenda. Any further action today?

>> no, judge.

>> we did not discuss items 32 and 33 and did not announce them. Number 34 we received a legal briefing on that one. The deadline for appeal is about a month and a half away. And I suggest that we wait on that and then decide whether to budget that small amount to get us through the end of the fiscal year. That's good enough, isn't it.

>> yeah, it is, judge.

>> number 35 is the matter involving the Travis County et al versus john devereaux and sharon jenson. I move that we authorize the judge to sign the prepared retail deed to cne real property llc, which has paid us the sum of $4,808.46 in cash.

>> second.

>> and this is lot number 3023 k 1 briar patches. All in favor? That passes by unanimous vote. Number 36, the matter involving Travis County et al versus jack and mary vaughn. I move that we authorize the county judge to sign the proposed tax resale deed. A second one to cne real property llc, which has paid Travis County the sum of $4,570.29 in cash. This is lot number 3271-bar k ranches plat 3.

>> discussion? All in favor? That passes by unanimous vote. Item number 37, might have that we authorize the county judge to sign the proposed tax resale deed to lindaura dasilva, who has paid Travis County the sum of $6,200 in cash. Discussion? And this is the case of Travis County versus the hamlets corporation. All in favor? That passes by unanimous vote. We did discuss a variety of recommendations regarding security measures and various county properties. That will be part of the budget process. In my view no further action is required today. Normally when we pull those items up, we approve the item when we budget it. 39, the --

>> 38?

>> I’m sorry, 38 were the security committee recommendations. No action require odd that today. We did not discuss 39. We did discuss item a-2. And received a legal briefing on that one. We are awaiting word from the administrative hearings officer about the hearings scheduled. And I guess that will be steps to be taken leading up to that. In my view no action required on this one today.

>> no.

>> a-4, we discussed. That's the matter involving the legal briefing regarding any prohibition against Travis County using public funds on health or mental health issues. There are several general restrictions that we were told about, nothing real, real specific. We were duly briefed, be and in my view no action required today. We did request a written summary of that legal advice, and hopefully that will be given to us as soon as possible for use in the future. Otherwise no further action. Is that all right, john?
