Executive Session
We are ready for executive session. 28. Receive briefing from county attorney and take appropriate action in sandra luna, individually and a/n/f kasandra luna v. City of Austin, Travis County and michael harley alt. 1 alt. 29. Consider and take -- by the way, 28 is consultation with attorney exception. 29, consider and take appropriate action regarding a settlement agreement with barecky construction co. For east metro park work. Consultation with attorney exception. 30. Receive legal briefing from county attorney and take appropriate action on suit against valdez remodeling and weatherization, inc and nautilus ins. Co. For water damage to residence at 1405 canterbury, Austin, Texas occuring on may 4, 2006. Consultation with attorney. And our last item would be number 31, also under the consultation with attorney exception to the open meetings act, receive briefing from county attorney and take appropriate action regarding the pending litigation in Travis County, Texas and state of Texas vs. Coldwater development ltd. And rodman excavation, inc., et al. As I mentioned, consultation with attorney exception, we will discuss these four items in executive session, but will return to open court before taking any action. we have returned from executive session. Where we discussed the four posted items. We will take motions this afternoon. Moving that we recess until 1:30.

this morning we finished all of our business except taking action on the items we discussed in executive session. Beginning with item no. 28, the luna lawsuit against Travis County and others, in my view we were updated. No action required. The matter is headed for trial and that's probably the best place for it unless the case is dismissed beforehand. 29, we were briefed on a proposed settlement agreement and based on that presentation I move approval.

>> discussion? All in favor? That passes by unanimous vote. Number 30 is a matter involving the residents at 1405 canterbury, Austin, Texas the lawsuit that resulted from damages suffered there. I move that we appoint dan mansour to represent Travis County in upcoming mediation.

>> discussion? All in favor? That passes by unanimous vote. 31 involves the -- lawsuit by Travis County and the state of Texas against cold water development and rodman excavation. I move that we authorize the -- the retaining of several consultants needed to do additional work for us in this litigation. We understand that the total will be approximately $70,000. Source of funding is
>> [indiscernible] management fund. And they mentioned three -- specific things that needed to be carried out in order to put together an appropriate report. And two distinct visits by the -- by the group or team. Approximately $70,000 is what's needed. That was seconded, right?
