Executive Session Items
We have come to executive session.
this morning we indicated our intention to take item number 12, which is to approve modification to the contract, stewart builders ltd, for construction of new buildings for the transportation and natural resources east side service center.
into executive session under the consultation with attorney exception to the open meetings act.
we have been asked to pull item number 28.
and remember this morning we pulled 27.
26 is to consider and take appropriate action on purchase contract with park limited 1 and 2 lp, and gdf realty investments limited for the acquisition of land in connection with the balcones canyon labels conservation plan.
that's under the real estate exception.
let's also announce consultation with attorney just in case we need it.
29, consider and take appropriate action on offers to purchase property at 9207 and 9301 johnny morris road locate understand precinct 1.
consultation with attorney and real property exceptions to the open meetings act.
30, consider and take appropriate action regarding offer received from mr. Peter barlin to purchase approximately 132 acres of land off of fm 969 in east Austin.
consultation with attorney and real property exceptions.
31, receive broafing from the county attorney and take appropriate action regarding the pending litigation in Travis County, Texas and state of Texas versus cold water development limited and rodman excavation, ning, et al, that's the consultation with attorney exception to the open meetings act.
and the final item will be a 1, which is to consider and take appropriate action on a counteroffer for 12 parcells of real estate, real property, and/or easement interest needed for right-of-way in the 2005 bond program, howard lane east 1, roadway improvement project located in precinct 1.
and a-one will be taken into executive session under the consultation with attorney and real estate exceptions to the open meetings act.
we will discuss these matters in executive session, but will return to open court --

we have returned from executive session where we discussed the following items. Number 12, involves a modification to the contract out at the east side service center.

we also discussed item number 26, the matter involving the balcones canyon lands con investigation plan and the possibility of acquiring additional land specifically, the park properties one and two.
we need additional work done between now.

we did not discuss 27 and 28.
29 is a matter involving the johnny morris road Travis County property.
we did get a letter from residents requesting that certain conditions be discussed with the potential purchaser and move that we ask staff to do that contact the prospective buyer about those conditions and hopefully be prepared to give us a report back next week.

and we had a discussion of numbers 30 and 31.
both of those need additional work.

I think staff knows how to proceed with that.

we discussed item a 1, the matter involving howard lane.

>> yes, move that we counter the counter off.
the counter offer $245,070 and we initiate a counter offer of $195,000 with the caveat and additional unused right-of-way, the fencing issue, and also the two medium breaks, actually the necessary in this particular project.
so with those three recommended aspects by county staff, I'd like to move approval of this particular item.

the cost to build are not for the county.

>> the $45,000 issue.
