Executive Session
I believe we've come to executive session. Following items are executive session items. 2 -- 27, receive briefing from county attorney and on extext of administrative leaf for juvenile probation employee. 28, receive briefing from county attorney and take appropriate action concerning the extension of administrative leaf with pay for juvenile probation employee in slot number 477, skull --consultation with attorney and --personnel matters exception. 29, consider and take appropriate action on purchase contract for the acquisition of land in connection with the balcones canyon lands conservation plan. Remember, we announced a postponement of items 30 and 33, postponed, are not be discussed in executive session. 31, consider and take appropriate action on proposed option agreement to purchase open space park land in southwest Travis County, that's the real property exception to the open meetings act. 32, receive briefing and take appropriate action regarding meeting with residents on proposals for the purchase of county property at 9207 johnny morris road in precinct one, consultation with attorney and real property exceptions to the open meetings act. 34, consider and take appropriate action on request to authorize the account attorney to join brief, the medical examiners of the state of Texas prepared by tarrant county trim nal did it attorney in relating to appeal from the 13 3rd district court, harris county in the matter of the medical examiner art uro and afsanehlsa ghian. And 35, consider and take appropriate action regarding the potential purchase of real estate on airport boulevard, consultation with attorney and real property exceptions to the open meetings act. We'll discuss these meaters in executive session and return to open court before taking any action.
we have returned where we discuss all items except two. So we'll have to go back to extive session this afternoon to finish our work. Move that we recess until 1:30. All in favor.
this morning we did finish our discussion of most of the executive session items, but we were not able to get to two of them, and it is those two that we will announce for discussion at this time. And they are number 35, consider and take appropriate action recording the -- regarding the potential purchase of real estate on airport boulevard under the consultation with attorney and real property exception to the open meetings act. And the other item is number 32, receive briefing and take appropriate action regarding meeting with residents on proposals for the purchase of county property at 9207 johnny morris road in precinct 1. Consultation with attorney and real property exceptions also. Can anybody think of any reason why we need to discuss for a second time any of the other items? Okay. Then we'll discuss those two in executive session, but will return to open court before taking any action.
we are out of executive session where we discussed the items we talked about this afternoon. We were in executive session this morning and discussed about five or six other items, including number 27. I move that we authorize six days of leave with pay to the employee who used to be in slot number 438.

>> discussion? All in favor? That passes by unanimous vote. On number 29 I move that we authorize staff to begin to negotiate to purchase the 21.592 acres of land for a total price of $5.6 million.

>> any discussion? All in favor? That passes by unanimous vote. We did not discuss 30 at all. It's been postponed until next week. 31 is a matter involving open space parkland in southwest Travis County. I move that we generally direct staff to touch base with the property owners, the reimers, for more specifics about a proposed agreement and report back to the court at the appropriate time.

>> discussion? All in favor? That passes by unanimous vote. 32 involves the proposals to purchase county owned property at 9207 johnny morris road. I move that we vote today not to transfer this property by lease or deed to the esd for the sum of $300,000. Because we have previously committed to sell the property and take the proceeds and apply that towards the cost of the consolidated office.

>> and that if this passes, would you like to send a letter to the esd and notify them of that?
>> yeah, weeg do that. In fact, we'll get the minutes from the particular clerk on this particular motion and then forward it to them because it was up for sale to take care of another obligation that Travis County has. This is the reason for that and I want them to understand that.
>> I do think they should know we feel duty bound to solve that commitment. Any more discussion? All in favor? That passes by unanimous vote. My second motion here simply is that we have this item back on the court's agenda next week and have staff to do due diligence about the nature of the proposed business, the rightness of the offer compared to the appraised value, maybe get broker comments about the possibility of other fires and any other relevant information for the court to consider next week.

We did not discuss item 33, and we announced that it was postponed much earlier. 34 is the matter involving the request for an am cuss brief. Did we say we would have this on this week? I do think in few of the reason that we were given, my motion is that Travis County submit an amicus brief where we basically setforth the position of our medical examiner, and especially the legal standards that we believe apply, the ones that have been in place basically historically and have guided us.

>> discussion? All in favor? That passes by unanimous vote. 35 is a matter involving the purchase of real estate by Travis County that is located on airport boulevard. I have a two-part motion -- let me try two separate motions here that our lawyer has provided us. The first motion is to approve first amendment to real estate agreement for property located on airport boulevard. It reduces the purchase price by $25,000, requires the seller to repair certain equipment on the property. And it sets a closing date of March tensth, 2008 or before. And these specific terms are setforth in the amy.

The second motion on this item, number 35, is to move that we direct consultants and county staff to prepare all documents necessary and appropriate to close this purchase and authorize the county judge to execute all closing documents proptly.
