Number 14, approve modification number 8 to contract number 401 t 0068 oz, cmi barron risk management services inc. For the third party administration for county's self-funded programs for workers' compensation and auto liability for following actions. A, assignment of contract from cmi barron risk management services, inc., to sedgwick claim management services, inc, and b, 12 months extension of the contract.

>> my apologies for not having gotten with you beforehand. Something I had noticed last night. I have no problems with 14 a. My question on the 12-month extension is that the contract has been in place since 2001 and I’m wondering about the appropriate time, when the appropriate time might be to consider a rebidding of the contract to ensure we're getting the best deal.

>> ible that --i believe the department came forward and asked the department to exempt from competition. It's up to the court if they want to continue that at the request of department or have us compete it.

>> what if any mechanism do we have in place to trigger that kind of consideration on an exempt contract? The your--user' communication to the Commissioners court?

>> we usually send out notice six months prior to expiration saying do you want to ec --extend or compete it?

>> we monitor the work of the third party office on a daily basis. What would trigger our request to bid the contract would be failure to live up to the contract, not doing the job as expected. But we developed a partnership over that period of time and certainly agree they are doing what we expect.

>> do we have any mechanism to look outside our experience and see if any has changed in the industry to see if anything has positively impacted in bidding of the new contract?

>> I think through different organizations that we are members of and different conferences and continuing education that we are learning what the industry standards are and best practices. When we do sit down with our third-party straighter we --administrator we do try to implement those.

>> bill patterson, in 2005 we did try to negotiate for extended periods prior to it being made. As dan said, we we visit various organizations or associations we talk to other vendors. Last year I asked what kind of money are you getting per claim for workers' comp. We're actually right in the ballpark.

>> that's all good news. Thanks for edifying me.

>> I think another consideration that the court would want to be aware of is the fact that there are some people in this county who don't negotiate as hard as others. I’m almost embarrassed to go into a negotiation with these people because they are so hard. If there were a way to get it lower, I’m sure dan would have gotten it ten percent lower than that.
