Number 14 is to consider and take appropriate action on the following request. A, designation of linda doly, --dooley, as health authority. B, designation of edward racht md and burch kimbraugh, md, each individually as alternate health authority for Austin Travis County health and human services department, and c, effective January 12, twaught. Cord--2008. According to the mails I’ve seen do we still need legal briefing on designation dr. Racht?
>> can I give it to you here or in executive sessionthe request is that we delay action on dr. Racht for one week. Is that still correct?
>> I don't think have you a legal prohibition. I think it would be merely a consideration of possible conflict.
>> I think the court needs to hear that.
>> if you like to take the week, I can give that to new writing and that way can you do his next week.
>> we can get in it executive session today. My motion at this time would be to go ahead and designate lynn williams doo dooley as health authority and dr. Kimbraugh as one of the alternate and delay action on dr. Racht until later today after we come out of executive session. I guess the city is looking at what we are doing on this.
>> that, judge, sherry flemming, executive manager for health and human services. They are aware of the questions legal has asked and they con tour with staff's recommendation to make the designations as you have identified and to come back later on dr. Racht.
>> we'll get the briefing today. I thought the court ought to hear it after I read the e-mails. We may conclude that after being informed, to go ahead and move on dr. Racht today. If so we can do it or take another week too. But this action covers dr. Dooly and dr. Kimbraugh exec January --effect January 12. We are back dating that to Friday.
>> yes, sir. This action is required due to the resignation of dr. Valdez who has served as our health authority.
>> okay. Anymore discussion? Executive session will be under consultation with attorney. All in favor. Thotethot--that passes by unanimous vote.
