resultation with attorney and real property exceptions to open meetings act.
a 1, receive briefing from county attorney and take appropriate action on the construction related erosion event in hays county.
associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County.
and a 1 is under the consultation with attorney exception to the open meetings act, also.
we will discuss these items in executive session, but will return to open court before taking any action.

We have returned from executive session where we discussed number 17, possible lease of county owned land adjacent to the community justice center.
we did get some questions answered.
we need followup research and a discussion and so we'll have it on the agenda on January 15th.
for further discussion and hopefully action.
number 18, the matter involving the selection of executive manager, justice and public safety, we did discuss the need for additional information from the three short listed applicants.
and I move that the county judge communicate our questions to executive manager danny hobby so that he in turn can ask the applicants for that information and we'll have this item back on the court's agenda next week for action.
seconded by Commissioner Davis.
any discussion?
all in favor?
that passes by unanimous vote.
number 19, the matter involving funding for additional building at the smart facility, I move that we approve this item which will bring our c.o.
issuance to the sum of $23,900,000.
is that right?

>> second.

>>

>> [inaudible] had that figure in it, however, the actual c.o.
will be 23,275,000.

>> that's the motion.

>> second.

>>

>> [inaudible].

>> on 19 year just including this amount which is $780,000, right?

>> it's actually around 800,000, including issuance costs.

>> okay.
and john is right, let's call up number 4, too, which would be an order authorizing publication of notices of intent to issue certificates of obligation.
so if we do 19 in the sum of about $800,000 in addition, that will bring the grand total to 23 million.

>> 275.
however, the order, glenn can speak to -- the notice is for 23,900,000.
in the event there's a premium that we need to do the upper limit.

>> so that would be the n.o.i.
portion.

>> item 4 is 23,900,000.

>> that's correct.

>> second that.
that is all included in the same motion.
we're doing 19 which is a additional 800,000.

>> that's correct, that includes that additional 800,000.

>> is that clear?

>> yes.

>> thank you.
discussion?
of those two motions.
all in favor?
that passes by unanimous vote.
and we did discuss a-1 and the need for additional work and gathering of additional information and having this back on the court's agenda at the appropriate time in the future.
should we give ourselves two or three weeks or just will we be notified when it's time to put it back on?

>> why don't we say a minimum of two weeks so that -- we really need to communicate and we'll bring it back.
there's too many issues that we need to keep driving.

>> we discussed several items. Do we believe that individual members of the court should in e-mail send john hilly maybe specific bases that we need to make sure we cover?
I don't know that they will all be different but that will be a way to pull together a cumulative list, I think, since we should not communicate with one another out of court.

>> if there are any outstanding questions, I'll be happy to

>> [inaudible] if there are any other outstanding questions.

>> you always do such a good job.
beg pardon?
this is all right, john.
we don't need to you talk directly into the mic.
you always do an outstanding job of covering what we discuss in executive session.
do you think you got everything today?

>> I cannot be sure I've gotten everything.

>> spoken like a lawyer.

>> any additional stuff, judge.

>> I think we ought to do that.
let's plan to have it back on in three weeks.
unless we're notified that we need it a week earlier.
how is that?
so we will do January 22nd unless notified otherwise.
okay.
and in my view that does it for the Commissioners court today, right?
