Citizens communication is next. This item gives residents an opportunity to address the Commissioners court on any item not on the agenda for up to a full three minutes. The first is phillip a. Dick followed by donna sturmon. Good morning.

>> good morning.

>> good morning.

>> good morning. I am here, as you know, I am here for my son. He's innocent, and I am -- this is a picture of my son. And I am fighting for his releases from state prison. When I was here last Tuesday, I talked to mr. Gus pena, and he had me to go back over to senator john whitmire's office, and mr. Lawrence coleman came out and he took my son's information and told me he was going to file life endangerment because his life is endangered in state prison. And I知 asking for his immediate release because he is innocent. Sheriff hamilton has already shown that my son was not arrested on the date that they claim that they sentenced my son to state prison. So I have talked with a friend of mine, and she has told me that maybe I need to go to have a criminal investigation started so that I can, you know, get my son released from state prison as soon as possible. Okay. I知 also here concerned about my civil action lawsuit that I was granted by the honorable judge patrick o'keefe on November 23, 2004, in courtroom 345. And at 9:00 a.m. In the morning. And I知 concerned because judge laura livingston has filed this cause and claims that I was in her courtroom and she dismissed it, and I知 trying to see how did she do that. And I was in judge patrick o 'keel's courtroom on November 23, 2004, and he's the one who granted me my cause of action and my judgment. He also ordered me on November 23rd, 2004, to resubmit dr. Wrightman's expert witness which he read in my original petition of

>> [inaudible]. Now, that was the only thing that I needed to do in order for me within 30 days to get my judgment signed by the judge to enforce my judgment. Okay? I have the paperwork, unsigned orders. I have been trying to get my orders signed by a district judge ever since 2004 and I have not been successful. The the judge who claims he gave me the 30 days to resubmit that is judge jenkins. I was not in judge jenkins room on that day and he did not grant me 30 days to resubmit. So he put my judgment at the appeals court level and took it out of district court and put it over to appeals court level to have my judgment reversed or changed. This is where mr. Albert alvarez is -- is judge o'keel's court reporter and this an e-mail letting me know he needed to get his files in order to help me because he remembers me being in his courtroom and he remembers granting me everything. But he needs his file so I -- and I asked him on this date and they stamped it. And I asked him for judge patrick o 'keel's orders. He claims miss latonya thomas was the court report other that date and I got a message from him.

>> thank you very much.

>> but I知 just letting you know that that's not true either. La tonya says she was not the court reporter for that day. Thank you.

>> thank you. Donna sturmon.

>> thank you all.

>> thank you.

>> good morning, Commissioners. We've come from the

>> [inaudible] committee to report our results from the race we had last Sunday, December 2nd. Dan will talk a little bit and then I値l tell you the money portion and participation.

>> before we get into the figures, we wanted to take a few minutes to recognize some individuals who really helped this year to make the brown santa 5-k race a success. And that is michael norton and anna marie, staff at the expo center. They really pitched in and helped when help was needed. They did an excellent job. We would like to help muna and david mitchell of the Austin runners club for their ores and hard work in setting up much of the race course in the banquet hall. And, of course, someone who we really want to thank for four years of service to the 5-k committee and that's bonnie floyd. She has been the nucleus and the glue that's kind of held us together. And finally we would like to thank Commissioners court for your continued support that's made the 5-k race really possible here in Travis County. So with that, I値l give it to donna.

>> I take care of all the money which is the fun part. And after expenses and what we brought in from sponsors and registrations, we netted about $5,014. $5,114. And about 240 participants ran between the adult run and the kids k.

>> for the record, what happens to that money?

>> it goes to the brown santa.

>> and that goes to needy families.

>> it's used to pay for turkeys, food, toys, right. Behind the scenes of the program, yes, sir.

>> and those items are given to families.

>> oh, yes.

>> less fortunate at christmas.

>> and the deliveries are this weekend, as a matter of fact, Saturday and Sunday will be the delivers at all the rural centers.

>> can you tell us how many families are going to be served this year? Like it's 1400?

>> 1400, yes.

>> that's incredible.

>> we do about 1300 families between all the rural centers and then we have a retirement community of 99 that we do every year and that delivery will be this Wednesday.

>> if anybody would like to see it in operation, it's on howard lane, correct?

>> the warehouse is on howard lane, yes, ma'am. The deliveries will be Saturday and Sunday at the rural centers. Del valle will be on Sunday and then Jonestown, oak hill, manor and Pflugerville will be Saturday.

>> do they still need packers for the family boxes?

>> they are wrapping as we speak, yes, ma'am.

>> if anybody would like to see the closest thing to santa's north pole, go out to howard lane and wrap some presents. It is an incredible operation.

>> state that address on howard lane.

>> I don't know -- it's 710 howard lane.

>> it's in the -- yeah, I think it's the 700 block of west howard lane. It's just east of i-35.

>> just down the street. Kind of catty corner from dell.

>> if you don't have the christmas spirit yet, that will do it for you.

>> right.

>> anything else?

>> on behalf of the 5-k race committee, we would like to present you with some of our shirts that were part of the packet for racers this year and we think they are very stylish this year.

>> can't figure out how we're going to outdo that next year.

>> thank you all for the good work.

>> thank you. That's extra large, right?

>> [laughter]

>> thank you. That looks nice.

>> should also point out that we had our sponsors of the 5-k race and they are shown on the back of the shirts and we really do appreciate their sponsorship.

>> dan, I didn't want you to think we didn't have anybody out there doing anything, but ms. Burleson participated in that 5-k.

>> and she finished ahead of me.

>> [laughter] most people did.

>> you didn't see me, but I was there in spirit.

>> [laughter]

>> thank you.

>> thank you all very much. Nibltion for citizens communication whether you signed in or not? Let's go to the consent items.

>> judge, before we go there, can I just maybe make a brief announcement of something that is posted in our particular agenda and that is tomorrow at 11:30 a.m. At the east metro park, which is located at 18667 lake manor road, we will have -- and we are asking everyone to please join us for a ribbon cutting ceremony for the community center out there. So it's very unique, state of the art, looks great. No other park facility has such a unique community center. So we are just encouraging the community to please join us at 11:30 tomorrow. Thank you, judge.
