29 is to consider and take appropriate action to accept probate -- 29 is to consider and take appropriate action on recommendation to settle liability claim from kemper auto and home and matt true due little.

>> this about an accident where a west bound vehicle, thoat the vk was going to turn in front of him, so he swerved to his right to miss the vehicle, and t bones mr. Doolittle, which ended up totaling his vehicle. Through investigation it did appear that she might have been turning, but she did stop before she did because our driver was turning too fast and in the investigation it was determined. So we feel like we do owe the claimant.

>> and this is just the personal property claim?

>> I project once we settle this claim with his insurance company, he was injured, so I'm thinking we will receive a pi claim, but stranger things have happened. He may have been treated moderately and went through his own insurance company and we may not, but that is a possibility.

>> in these sorts of case sz there any sort of driving mediation required for our driver?

>> well, our vehicle was totaled also and that will be coming in front of the Commissioners in November. We usually try to wait and address our damage claim. There was disciplinary action on the part of the office, yes.

>> move approval of the staff recommendation to settle.
