I think we have come to executive session, haven't we? Item 33, consider and take appropriate action in Travis County, et al., versus center hill joint venture, frank yi resale deed. This is under the consultation attorney exception on the open meetings act. 34, consider and take appropriate action on an offer to sell 5.204 acres of undeveloped remainder land from state highway 130 for acquisition of Travis County's onion creek open space parkland as part of the 2005 bond program, proposition 2, project number 3140, wpeo 1-2000-05 b 02 a. Why we have all those numbers, I don't know, but they are in the item. Located in precinct number 4. That's the consultation with attorney and real estate exception to the open meetings act. 35, receive briefing from the county attorney and take appropriate action in Travis County, et al., versus gale allen, corpus christi big woods drinking range resale deed. Consultation with attorney. 36, receive briefing from the county attorney and take appropriate action in Travis County, et al., versus highland mall boulevard, ltd. Jin song wu resale deed. Consultation with attorney exception. 37, receive briefing from the county attorney and take appropriate action in Travis County, et al., versus iola l. Greer, jamileh noshari resale deed. Consultation with attorney exception. 38, receive briefing from county attorney and take appropriate action on the following: a, construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County. B is settlement agreement proposed by Texas commission on environmental quality. A and b are under the consultation with attorney exceptions to the open meetings act. 39, consider and take appropriate action regarding cole and powell law firm, invoice for legal services rendered is a, and b, status of contract. Both of those are under consultation with attorney, both parts of 39. And 40, consider and take appropriate action on request from project diamond back for financial incentives. That's consultation with attorney exception to the open meetings act.

>> then I'll -- did I leave open that possibility this morning? I'm smarter than I think sometimes, john. And number 27, we'll consider also under consultation with attorney, a matter involving b.f.i. Discussing this morning as if we didn't have enough discuss, consider and take appropriate action on a, draft agreement with b.f.i. Waste systems and giles holdings, lp. 27-b, response from executive director at the Texas commission on environmental quality, tceq, to proposed amendment to tceq municipal solid waste msw permit number 1447, b.f.i. Sun set farms landfill. And c, other related issues. And 27 and its entirety will be under consultation with attorney. We'll discuss these matters in executive session, but will return to open court before taking any action.


we have returned where we discussed the following items, number 27, the b fi item, we did chat with legal counsel, got advice and asked for certain information in preparation for some action next week. This matter will be back on the court's agenda October 0. Anything further on this item today. We'll have it back next week. 33 we did not discuss. We did ask a member of the court to gather some information for us. Number 33, the frank yi resale deed will be a back on the agenda next week also. 34 is the matter involving the 5.204 acres of undeveloped remainder rand from sh 130. I move that we accept the offer.

He had to run to another commitment. Number 38 is the appropriate posed tax resale deed to corpus christi by woods driving range, inc. I move that we authorize the county judge to sign the prepared, sorry, what number did I say?

>> 35. Don't want get ahead of myself. Number 35, corpus christi big woods driving range incorporated which has paid Travis County the sum of $3,100 in cash. Move that we authorize the county judge to execute the document on behalf of the court.

>> any discussion? All in favor. That passes by unanimous vote. On number 36, we authorize the county judge to execute the tax resale deed to song wu who has paid Travis County the sum of 4,355.74second.

>> discussion? All in favor? That passes by unanimous vote. Item number 37, I move that we authorize the county judge to sign the prepared tax resale deed to jamileh no shari who has paid Travis County the sum of $10,800 in cash.

>> discussion in all in favor? That passes by unanimous vote. Number 38 is a matter involving the erosion event in hays county and impact on Travis County, specifically the hamilton park/creek, hamilton pool/creek and other bodies of water. I move that we accept the prepared authorize that thorizes the county attorney to proceed with appropriate legal action and that we tar--all tar the submitted document to read hamilton pool/creek in every instance where hamilton pool occurs in this three-page document.

>> anymore discussion?. All mthat passes by unanimous vote. Further, we understand the county attorney will meet to discuss this matter and the appropriate action will take place at the appropriate time. And authorization is given to proceed today.

>> number 39 is the matter involving the invoice for legal services from cole and powell law firm. I move that we approve the invoice in the amount of $10,339.72. Second by Commissioner Davis. Discussion? All in favor of the motion. Show Commissioners Davis, Gomez and yours truly voting in favor. Commissioner eckhardt voting against. Number 40 we did not, we did discuss but not ready for action today. Commissioner eckhardt now will do a little bit of additional work on this to provide more information to the court and have it back on the agenda on October 30, 2007, next Tuesday for further action. Ms. Porter, I believe that does it for today.
