Executive Session

Good after noon, let's call back to order the voting session of the Travis County Commissioners court. Commissioner Gomez is out today and Commissioner eckhardt was summoned for jury duty. We do expect her to join us, rejoin us this afternoon as soon as possible. If she's allowed to do so. But the three of us will try to carry out without them. I didn't call back to order the voting session, did i? I did?

>> he did? Okay. In that case then why don't we go into executive session and take the corporations after -- after we adjourn the Commissioners court meeting and there are a couple of other items that we need to call up that are not executive session, but a part of the voting session today. But the executive session items are follows, 40. Receive legal briefing regarding legal analysis of draft agreement with bfi waste systems of north america, inc. And giles holdings, l.p. And take appropriate action. That's the consultation with attorney exception to the open meetings act. 41. Receive briefing from county attorney on a construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County, and take appropriate action. Consultation with attorney. 42. Consider and take appropriate action on counter-offer for right of way acquisition from ada ellison for parcel #25/25te as part of the howard lane east ii road improvement project - cip #3110-n09700000-05b01a. There's five of them 0's. Consultation with attorney and real property exceptions to the open meetings act. We previously announced the postponement of item no. 43, we will not take it into executive session. 44. Consider and take appropriate action regarding invoice from cole and powell law firm for legal services rendered. Consultation with attorney exception. 45. Receive briefing from county attorney and take appropriate action in Travis County, et al v. Hank peavler development company, inc. (ev land development, llc resale deed). This is the consultation with attorney exception to the open meetings act. And we may as well announce the real plot exception to the -- real property exception to the open meetings act, also. We will discuss these matters in executive session.

Thank you very much, sure do. 12 a was a matter involving one of the liability claims this morning. 12 a was the matter involving the liability claim from garden city boxing club, inc. - deny; and paul clahasey - deny. So we will add that to the items we will discuss in executive session. We will come back to open court before we take any action.


we are back from executive session. 12-a, the liability claim involving garden city boxing club, inc., recommendation is to deny. We did discuss this matter. I move that we follow staff's recommendation and deny the claim.

>> discussion? All in favor? That passes by unanimous vote. For the record, Commissioner eckhardt is still at jury duty and Commissioner Gomez is out today so the three of us will continue. Now going to the items posted for executive session, item number 40 involves b.f.i. Waste systems and giles holdings, lp, we did get the legal briefing of no action bri. No action required today. We'll have it back on the court's agenda, release and public discussion at a later date. A draft document. And we'll know further about it next week. That's item number 40. Item 41, we got the legal briefing also. We'll have it back on next week just in case action is necessary. We are waiting on a consultant report and some other information. 42 is a matter involving right-of-way acquisition from ada ellison. I move that we accept the offer to settle and sell this property to Travis County for the amount of $31,399.

>> discussion? All in favor? That passes by unanimous vote. And by the way, this should be howard lane east 1 road improvement project instead of east 2. We'll have another item on the agenda next week for us to ratify that change just in case someone wishes to come down and talk with us about it. We did not discuss the next item, number 43. It was pulled. 44, we did discuss that. No action required today. We'll have it back on next week. Just in case the court wants to take action. Item number 45 is a matter involving the resale deed to e.v. Land development, l.l.c. He move that we authorize the county judge to sign the proposed tax resale deed which involves about 15 parcels of land; specifically lot numbers 70, 75, 76, 77, 74, and lot number 73. We have received $2,421.34 for each of them. So that was one, two, three, four, five, six parcels of land. We received the same amount of money, $2,421.34 for each of those. And the next parcel will be lot number 72 for which we received $2,596.16. Lot number 86 for which we received $1,734.04. Lot number 80, for which we received $2,220.65. And lot number 78, for which we received $2,672.91. And finally, this deed includes about five other lots, for which we received the sum of $2,421.34 for each of them. That's lot number 94, lot number -- 87, rather, 87, 81, 82, and 79. That ought to add up to 15 lots and we received the same amount of money for 11 of them and different sums for four. That was seconded by Commissioner Daugherty. Discussion? Elliott, that was all right? We'll give my copy to the clerk in case -- you have one already. All in favor of the motion? Show Commissioners Davis, Daugherty, yours truly voting in favor.
