Executive Session

Then we will take this item (40) into executive session under the consultation with attorney exception to the open meetings act. By the way, this morning we announced the postponement of 42 and 43. Let's add to that 45. We were notified during lunch by gary martin, attorney, that we could postpone 45 until next week.

>> a couple of these, I thought we would take them because we had people. Is 38 the executive manager's item?

>> no, the utility right-of-way.

>> I think john hill will be the one to talk to us on that in open court. I think that is fairly routine. 41 is to receive briefing from county attorney on a construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County, and take appropriate action. That's consultation with attorney exception. 44, receive briefing from county attorney and take appropriate action regarding settlement offer in janice baiting workers' compensation lien case sub row gages. Consultation with attorney the. 46, consider and take appropriate action regarding lease agreements between city of Jonestown and Travis County for space located at 18649 highway 1431. Consultation with attorney and real property exceptions . And number 47, consider and take appropriate action on the potential purchase of real estate along airport boulevard. Consultation with attorney and real property exceptions. We'll discuss these matters in executive session under the appropriate exception but we will return to court before taking any action.


We have returned from executive session where we discussed the following items. Number 40, the proposed resale deed to frank yi. Is there is a motion?

>> judge, I would make the motion that we reject all the bids and had a we advise the county attorney's office to set up a special arrangement for dealing with this particular piece of property.

Number 41 is a matter involving the erosion event in hays county. We did get a briefing om st staff. I can't think ofany action required today. Can anybody? We'll have that matter back on at the appropriate time in the future. We did not discuss 42 and 43. We did discuss 44, the matter involving janice bading. I move that we accept the insurance company's offer to settle this matter after the county accept is a 25 percent reduction in our claim that we authorize the county attorney to file lawsuit on Thursday unless this matter has been resolved.

>> is to provide electricity for the drilling operations going out there. You have an entity that is drilling out there and is running off a generator right now. They can work more efficiently if they had electricity coming out to the property. >> yes, 39 is to consider and take appropriate action on adoption of process and schedule to conduct performance evaluations of executive managers and certain other managers. A month so when we looked at this matterwe tkeabout doing ese evaluations. We missed our opportunity in fisc '07 what diin ae-mail was to send out a prosed chedule, and what I tedtoo was pu enoughime inthere f the lf-eation. Edh has helped us in the past and if she is vaable is ar sicallweive almo amont to the executive managers self evaluate. We'd receivetse, give ourselves roughly two eks to prepare our evuaons, give those to edith, and I think she has about a week ten days to compile master valuationsfor us. Then we would couct thos evaluations. I s trying toeat thksgiving. I have recommeed Tuesday before the week of thanksgiving. In the e-mail I ave specif dates. Have ki ospread it out. The other thing that I'm thinking that we may be, whatever actions we propose to take in '08, if any, maybe we ought to go ahead and take them after these evaluations. Historically we have kind of waited until later in the year but I don't know that that was by design anymore than sort of looking up mid summer and realizing the end of the fiscal year was approaching. We can think about that later but if we do these evaluations, we get them done by mid November I ess when you asme about e probability of doing a second evaluion before September 30, iuld ththat very low it maye n oppounity to kil two birds with one stone.
