Executive Session

I best we have roger somewhere near. A 1 to receive status update and take appropriate action regarding lease for community supervision and corrections department day treatment program. There will be under the consultation with attorney and real property exceptions to the open meetings act. A 2, rereceive status update and take appropriate action on lease for community soup investigation and corrections department, mental health and mental retardation programs. That's the consultation with attorney and real property exceptions to the open meetings act also. A 3, receive briefing from county attorney and take appropriate action on extension of administrative leave with pay for constable precinct two office employee in slot 36. That's consultation with attorney. So I have announce the a 1, a 2 and a 3. Just in case the county attorneys are ready, 43 is to receive briefing from county attorney the on the construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County and take appropriate action. That's the consultation with attorney exception. 44, receive legal briefing on county land use authority, a follow-up discussion to our discussion last week. Consultation with attorney exception. And let's announce 45, receive briefing from county attorney and take appropriate action concerning the extension of administrative leave with pay for constable precinct four office employee in slot number 3 consultation with attorney and personnel matters exceptions. I didn't announce the others because I think we have outside consultant coming in on those. We'll discussion these in executive session but return to open court before taking any action.

that may get us to executive session. 41, we did discuss some of those items. 41 is to consider and take appropriate action on the potential purchase of real estate along airport boulevard. Consultation with attorney and real property exceptions to the open meetings act. 42, consider and take appropriate action on request for financial incentives from project diamondback. That's the economic development exceptions to the open meetings act. I did touch base with the Austin chamber of commerce and they will have either one of their reps or a rep from the company here this afternoon. We'll be able to chat with them in executive session, right? Under this item?

>> I thought that the confidentiality aspect would allow it to be executive session.

>> we'll do quick research while you are taking the other items.

>> then if the greater Austin chamber of commerce rep comes, no problem, but if there's a company rep.

>> yeah, that would be a problem. We'll get back with you.

We did not discuss 43 this morning, receive briefing from county attorney on a construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County and take appropriate action. We were requested to postpone item number 45 by the county attorney's office so we won't announce that one, we will not discuss it. 46 is to consider and take appropriate action on issues regarding sale of county property located at 6701 burnet road, Austin, Texas. That's the real estate exception. It's also the consultation exception for 46. We did discuss a-1, a-2 and a-3. We will not discuss those again. We will take action when we come back. We will discuss the items we just announced, but will come back to open court before taking any action.


we did not discuss number 41, that was postponed. 43 we did get an update, that's the matter involving the erosion event in hays county that impacted hamilton pool. We will have this back on the court's agenda in two to three weeks when there is additional information that should be available. Any action today? Okay. We discussed number 44 also and will probably have that back on the court's agenda for a specific follow-up in the future, probably two to three weeks from now based on today's conversation. 45, we did not discuss, did we?

>> that matter was pulled. 46, we did discuss and we will need planning and budget to work with facilities management to transfer in the facilities management department the amount of $859. And roger suggests that a budget transfer from lease saving account to a line item that will allow them to pay a contractor for services provided at the farmer's market would be good. And they're looking at budget adjustment number 6876. And roger thinks that will get it done. We'll have this matter back on the court's agenda next week, but that's the motion, I guess, for pbo to work with roger on getting that done.

>> do you want a restrictive covenant authorizing to you sign that?

>> I thought we'd draft it and get it to the attorney -- maybe have it back on next week.

>> still timely. Urks yeah, probably good to give them an opportunity to respond to it. And we'll have this back on next week for discussion of the restrictive covenant. Any other part of this item that's appropriate. Okay? And a-1 is a possible lease of space for the community supervision and corrections department. We did give directions for staff to meet with the impacted neighborhood associations. This is over near 11th and gloorngs so they can examine a phone call from community supervision and county facilities management office some point in the near future so that conversations can be arranged.

>> what did I say?

>> 11th and 35 is what it's near. Okay. That's a better location. I think guadalupe neighborhood association is --

>> that would be here.

>> [ laughter ]

>> all right. A-2 involves a lease space for community supervision and corrections departments, mental health and mental retardation programs. I move that we authorize that the county cover 56% of the lease costs there, which would be $83,707, and be also its costs of 81,344. This will be a the budget worksheets tomorrow. But with let's authorize staff to go ahead and proceed with negotiations of this contract.

>> yeah. And judge, I'm going to support this based on what we have heard and discussed with staff. Staff saying that the neighborhood associations were on board with this particular agenda item. In orders, supporting it. So with that, I'll support this. So I wanted to make sure that's a matter of record.

>> all in favor? That passes by unanimous vote. A-3 is a matter involving the request for administrative leave with pay for the employee in the precinct two constable's office in slot number 36. Move that we authorize an additional 29 days, which will cover through August 30th of 2007.
