Item 36 and 37
36 is to consider and take appropriate action on agreement regarding use of vehicles with conjunction with off duty employment of county peace officers. We do have a couple constables here. You are all here? From jim colins I have a note that says there is some concern by the auditor's office regarding the use of the word grant in the form agreement submitted for our approval in 36 and 37, and based on what's in the code, section 81.032, the Commissioners court is allowed to accept a gift, grant, donation, et cetera. The recommendation is that we term, we use the term grant. No, that we replace grant with the term donation in the form agreements that are represented--that are recommended. And that the three things that we do today is to approve the form agreement after making that change, basically have them execute it by sheriff and constables, and that we move the court to accept reimbursement under section 81.032 of the local government code. Jim?

>> 37 is to consider and take appropriate on agreement for reimbursement of constable vehicles used in extra duty activities. And these items are in response to the opinion by the Texas attorney general that our old way of collecting reimbursement may not be quite legal, but this will get it done.

>> my motion is to approve 36 and 37 that we substitute donation for the term grant in the form agreement, and that we ask our cooperating and partnering sheriff and constables to execute those form agreements asap.
