Number 1 is a public hearing to receive comments regarding request from spansion llc for nomination to the governor's office as a project under the Texas enterprise zone program pursuant to section 2303, Texas government code. I --

>> move that the public hearing be opened.

>> second.

>> all in favor? That passes by unanimous vote. Let me just note that -- that initially the request was that we consider requesting the designation in November -- in September. We subsequently decided that December was a lot more realistic and so now we are on a December time line. So we will not have the action item, which is number 38 today. But we do have the public hearing, so if you are here to give comments on this item, please come forward. We expect action to be taken in October or November in preparation for a December deadline. Anybody here on this item?

>> move that the public hearing be closed.

>> second. But let me say this. Let me make a comment before we close the public hearing. If the applicant request, I would also request that they go back to the city of Austin. Austin, as you know it was given in earlier testimony, they came here because the city of Austin directed them to come here, they didn't have the time to deal with it. My question now is since this is in the city limits and also we do not benefit from this at all, as far as what is part of the -- of this particular action, the county, I would request that the city also have another peek at this because it does benefit the city a lot. We talked about sales tax revenue, a whole bunch of other things, things within the city limits, this is within the city limits of Austin. They do have an enterprise zone set up. This may allow the city to look at this again. From my support I think that they need to -- to -- to go back to the city of Austin since it's been delayed, I think now they do have the time to allow the city of Austin to look at this in December. I think it's enough time.

>> all in favor? That passes by unanimous vote.
