Executive Session
Ms. Porter, I believe that gets us to executive session, doesn't it?

>> we were advised over lunch that one of the -- another one of the executive session items has been postponed, that is number 45. So 45 is postponed as well as a-3. Now, that leaves number 40 to discuss in executive session, and 40 is to consider and take appropriate action regarding a request from spansion, llc to nominate it as a project to the governor's office under the Texas enterprise zone pursuant to section 2303 Texas be government code. And the request to construct a public hearing on September 4th, 2007 as required. Urnt the consultation with attorney it exception to the open meetings act in executive session. 41 is to take and --

Somebody told me that and I forgot. 41 postponed until next week. 42, receive briefing from the county attorney and the fire marshal regarding 21018 state highway 71 west, spicewood, Texas, and noncompliance with the Travis County fire code and orders of the fire marshal and take appropriate action. Consultation with attorney and real property exception to the open meetings act. 43, consider and take appropriate action on issues regarding sale of county property located at 6701 burnet row, Austin, Texas. That's the real property exception to the open meetings act. Let's also announce consultation with attorney just in case we need it. 44, consider and take appropriate action on request for financial incentives from project diamondback. And that's under number 5, the new one, economic development negotiations exception to the open meetings act. 46, consider and take appropriate action on performance pay for executive manager. That's the personnel matters exception to the open meetings act. Number 47, receive legal briefing on county land use authority. That's the consultation with attorney exception to the open meetings act. And our last item for discussion in executive session -- rita, I think we can take a-2 as part of 40, can't we? That's ratify setting -- I have set the public hearing already. Maybe when we come back out, we can just take action on that to ratify it. So we'll discuss that under 40 and I think we'll have the same legal advice there. We'll discuss these matters under the announced exceptions to the open meetings act, but will come back to open court before taking any action.
number 40 involving the request from spansion, suggest we take no action today, have it on the gen take next week in case we need it. I understand work will take place in the interim and maybe it will be ready for action, maybe not. Did not discuss 41. We postponed that one before executive session. 42 we did discuss. I move that we authorize the fire marshal and the county attorney to initiate appropriate legal action to get compliance with the fire code, including any sort of injunctive relief, request for damages, and any other lawsuit matter that is appropriate based on the facts of this case.

>> they want to have it out there just in case. But no action will be taken on that for at least two weeks. We'll have it back on the court's agenda two weeks from today. That is September 11 for follow-up discussion prior to the legal action. Give you an opportunity. Is that okay?
>> you're asking that we prepare but don't pull the trigger, so to speak, until coming back in two weeks.
>> I think it would be good to send a signal that authorization to initiate legal action has been given.

>> and once there's a document prepared, the county judge will sign that?
>> yeah, and I will sign that late this evening or tomorrow morning before ten if I have it.

>> I had forgotten about that part. Okay. That is all friendly to the motion? All in favor. That passes by unanimous vote. We did discuss 44. Let's take another week, give court members an opportunity to mull over the request. So 44 we'll have back on next week. I did not discuss number 45 and did not take it into executive session. 46, I move that we authorize the county judge on behalf of the Commissioners court to execute performance action forms from the human resources department, give the executive managers and the two previously acting executive managers coburn and baldwin, a one percent pay increase, and for the acting executive managers based on their department head salaries.

>> and we do that on behalf of the court. Discussion? That will be all of the executive managers plus those two. All in favor. That passes by unanimous vote. We did discuss 47, did not complete our discussion. We'll have it back on next week, john, for follow-up legal advice. And if there are other questions from the court, we'll have a chance to ask those too. And those were the items we study in executive session today. Spansion? That was part of 40.
