Now I believe that gets us to executive session, doesn't it? We did announce that we were calling into executive session the two 9-b and c, and those are the liability claim recommendations for b, January janiceaulc and russell. That's under legal consultation. Let's go to added item number 3 which is to receive legal briefing regarding authority to regulate dangerous industrial uses in residential areas. This is under the consultation with attorney exception to the open meetings act also. And we also have posted under executive session number 41, consider and take appropriate action regarding salary adjustment for director of counseling and education services for performing additional services in justice and public safety department. That is under the personnel matters exception. 42, receive briefing and take appropriate action in Travis County versus montclaire townhouses, sherwin buydense resale deed. Consultation with attorney exception. 43, receive briefing from county attorney and take appropriate action on settlement demand, eeoc charge number 451-2007-00612. I have to have three people in here, right, john?

>> have you to have one of them in here. I was in the middle of reading 43, receive briefing and take appropriate action on settlement demand, eeoc charge number 451-2007-00612, consultation with attorney exception. And number 44, consider and take appropriate action on issues regarding sale of county property located at 6701 burnet road, Austin, Texas. That's under the real property exception and let's announce consultation with attorney exceptions to the open meetings act, but will return to open court before taking any action.

We have returned from executive session where we study the following items. 9 b, liability claim of janice auld. The recommendation is to deny the claim. I move that we degree to settle the claim for $200, the amount of the window that was broken. Discussion?

>> what was the motion?

>> to approve the $200 claim from janice auld to replace the window that was brokeni'll second that--

>> I'll second that.

>> Commissioner Daugherty has seconded that already. We do need you, hold on.

>> .

>> she was using her own vehicl.

>> county duties clearly and clearly in the performance of duties and responsibilities that were clearly work related.

>> (inaudible)

>> that sounds good to me. Discussion? All in favor? That passes by unanimous vote. The claim of wade h russell involving the cash bond, any motion on that?

>> to follow staff recommendation.

>> follow staff recommendation to deny?

>> that is how the motion guess every weekis there a second? --

>> is there a second?

>> second by Commissioner dougherty. Discussion. All in favor. Show Commissioners eckhardt, Gomez, dougherty voting in favor. Voting against, Commissioner Davis. Show judge Biscoe present but abstaining. . I'm glad you mention that. Move we approve staff recommendation on a, steven torres, settled.

>> second.

>> all in favor? That passes by unanimous vote. Moving though those posted under the executive session category, 41, matter for director of counseling and education services. Move that we authorize the county judge to execute an appropriate paf increasing ms. Coburn's salary four percent above her permanent salary. It's a little tricky because we increased to eight percent when we gave the temporary duties and responsibilities. We were about to reduce that back to zero because she was no longer performing those but she will perform about half of them. So the four percent of the eight percent is appropriate. We'll get that done in spite of the long explanation.

>> second.

>> discussion? And the an understanding is that she will perform some of the duties and responsibilities of the justice and public safety coordinator. All in favor. That passes by unanimous vote. Number 42 is a matter on the court's agenda last week involving the sherwin buydens resale deed. We got our questions answered. Any other issues? Move that we authorize the account judge to executes the prepared tax resale deed to sherwin buyden has who has paid Travis County the sum of 16,450 in cash.

>> second.

>> discussion? All in favor. That passes by unanimous vote. Number 43, we received a counter offer in the matter of eeoc charge number 451-2007-00612. Move that we reject the counter offer.

>> second.

>> discussion. All in favor. That passes by unanimous vote. 44 we discussed. That's the farmers market on burnet road. Any discussion? It will be back next week. We did give staff sort of directions, not formal john but more informal. I will have it back on next week just in case we're ready to take action. And we discussed a 3, god legal advice. Should we have it back on next week? Two weeks? Will you be ready to report back?

>> I take uple weeks

>> okay, couple weeks is September 4.

>> yoreoivati.

>> great idea.

>> let's have it on in two weeks. If we are not ready in two weeks weilpopo atry to be ady. Allht.

>> let's try to squeeze as much work out of her before she goes on vacation. Yes, sir.

>> is the intent of a 3, and the time that we are taking a look at this thing, to do something to try to move it forward? The main track is moving it forward.

>> they are still studying it as we speak.

>> according to my records, that is it for today.
