>> we have returned from executive session where we discussed several items that we are take motions on this afternoon.
I think that brings us back to executive session, doesn't it? And I'm happy to say that this morning we discussed most of our executive session items. We announced but did not -- no, we did not announce number 3. We need to discuss it. 30, rather. 30 is to receive briefing from county attorney on a construction related erosion event in hays county, associated water quality and environmental impacts on hamilton pool and other natural resources in Travis County, and take appropriate action. This is the consultation with attorney exception to the open meetings act. 40 is to receive briefing from county attorney and take appropriate action on settlement demand, eeoc charge number 451-2007-00612. And number a2, consider and take appropriate action on the potential purchase of real estate along lavaca street, this will be the real property exception and the consultation with attorney exceptions to the open meetings act. We will discuss these three items in executive session but will return to open court before taking any action.
We have returned from executive session, number 30, involving environmental impacts on hamilton pool and other natural resources in Travis County, of a construction erosion problem in hays county, I move that we authorize $11,000 for the county attorney's office and the transportation and natural resources department to retain appropriate consultant assistants, and that this money be taken from the allocated reserve.
>> second.
>> discussion? All in favor. That passes by unanimous vote. 31 involves the howard lane project. Move that we reject the counter offer in this matter and reurge the county's offer of $25,935.

>> second.
>> any discussion? All in favor. That passes by unanimous vote. My recommendation is number 36 is that we postpone action on it and ask the county attorney to report to us back next week about a few more specifics about this matter, including a picture of the property and any more details that may assist us in our desire to understand the specifics.
>> second.
>> any problem with that? Instead of a motion? No objection. Is that okay?
>> yeah.
>> I think we all would like to see a little bit more about that. Those are just directions.
>> direction should be sufficient.
>> okay. 37, I move that we authorize the county judge to sign on behalf of the Commissioners court the proposed tax resale deed to, on this one, a little bit different actually, the agenda, and the other information says he's are two deeds. Maybe that's the reeb reason why it's a little different. Actually, I guess 37 and 38 go together, don't they.
>> I show two lots on 37.
>> two lots on 37. 37 and 38 are different.
>> okay. But on the agenda we have the grantee being kasandran and deal taylor. Maybe I had them out of order.
>> you had it right.
>> I didn't have the dean in my hand. Looking at the agenda plus the deed. But I have it now. 37, I do have a deed here to kasandra, dean taylor, involves two thacts. The first one they paid 3,250, and it's building 793076, aka 60152. And the second tract of land is $3,070 for building number 753089, aka 60150. Move that we authorize the county judge to sign these.

>> judge, I don't think that's the correct amount. I think the amount is $3,201 on 38.
>> right.
>> it's the offer.
>> does the resale deed have a different amount?
>> yes.
>> 38 is $38--we will not take an on that today. We will have the matter clarified. I do have my glasses on. I may have missed it by a few dollars but not 13,000. Hold on, though. Here is a deed. Now I see. That should have been number 36.
>> yes, this is 36.
>> okay. Hold on. Let me see this other one.
>> we set that one aside.
>> okaynext one that one is supposed to come back.
>> the same person.
>> next week, 3.
>> okay. 36, that is a problem. Thank you all. We have another one for sherwin buydens for $3201 in catch. And it's item number 38. It involves a property at 19514 blanco drive. Move that we authorize the county judge to sign.
>> second.
>> discussion. All in favor. That passes by unanimous vote. Next item, number 39, it is a proposed tax resale deed to cse development llc.

>> any discussion. All in favor. That passes by unanimous vote. Let me make a notation on this one here so I won't miss my place again . Won't have to come get you all to help. Next is the number 40, the eeoc charge. My view, no action required or report today. We'll have this matter on the agenda next week, just in case there is a report back by the county attorney and we need to discuss it. That was number 40. Number 41 involves the potential purchase of real estate along airport boulevard. Any motion?
>> yeah, judge, I move that we direct staff to enter into documentation for an option to purchase the property along airport boulevard from 90 to 60 days.
>> secondseconded by Commissioner Gomez, that basically is to sign an option to purchase?
>> yes.
>> okay. Any discussion of the motion? All in favor. Show Commissioners Gomez and Davis voting in favor, voting against, the rest of the court. Move that we authorize staff to put together basically information describing how we would use this property, that we ask our consultants to contact pretty owners, indicate to them that we are trying to gather specific information to justify purchasing this property at their asking price, and that staff, including roger l cory and other property county staff report back to us in two weeks. I did not know at the time that roger would be gone a week. That's why we need two weeks. Hopefully that will move us to the next step.
>> second.
>> any discussion of that motion? Any other actions necessary to make that happen and put us in a better position to take action two weeks from today. Anymore discussion? All in favor. Show Commissioners eckhardt, Daugherty, Gomez, yours truly votting in favor, Commissioner Davis voting against.
>> abstain.
>> Commissioner Davis abstaining. A 2 is the matter involving the potential purchase of real estate along la vaca, and it has been suggested that the court authorize the county judge to sign a new document from the title company, but one that makes all the sense in the world and authorize judge Biscoe to sign an investment account authorization to allow heritage titlep company of Austin to invest $100,000 in earnest money for purchase of the said property on la vaca, in interest bearing account.
>> second.
>> doesn't say here john, but should we ask that interest be shared with us or given to us?
>> it will be credited to you. The interest will follow the money.
>> we understand that the interest will follow the money and belong to Travis County.
>> correct.
>> that's part of the motion to.
>> is there a motion to make a ridiculously high interest?
>> gets better all the time. Anymore discussion? Let's thank our friends out at heritage land title that they pull this off. All in favor. That passes by unanimous vote. I am happy to say that there is no further business today.
>> move adjournsecond.
>> all in favor. That passes unanimously.
