Executive Session
Now let's call back to order the voting session of the Travis County Commissioners court. And I suggest that we convene in executive session at this time to try to discuss some of the items that we said we needed to discuss there, beginning with number 12, consider and take appropriate action on request of resolution of requiring penske truck company lp to remove hazardous waste from the Texas disposal systems landfill, inc. Site and this will be under the consultation with attorney exception to the open meetings act. Also item number 17, consider and take appropriate action on contract for legal services of appeal of oak grove plat permit under the consultation with attorney under the open meetings act also. And the three items posted for executive session today. Number 43, receive briefing from the county attorney and take appropriate action in Travis County et al versus u.s. Life tieghts company of Austin, aka title u.s.a. Company of Austin, city of Austin resale deed. Under the consultation with attorney exception to the open meetings act. 44, receive briefing from county attorney and take appropriate action on claim by jennifer maldonado, former slot number 45, eeoc charge number 31-c-2007-oo 733. That's the consultation with attorney exception to the open meetings act. And item number 45, consider and take appropriate action regarding appropriate disciplinary action for transportation and natural resources employee in slot number 376. And that will be posted under the personnel matters exception to the open meetings act. Let's also announce 45 under the consultation with attorney exception. We'll get as much done as we can between now and about 2:00 when we will come back to open court before taking action on any of the announced items.

We have returned from executive session where we discuss the following items. By the way, we were in executive session from about 1:40 until 2:15 and went back into executive session probably an hour or so ago. So we did not take motions this morning, early this afternoon when we came out the motions will cover both sessions. We discussed number 12 involving a request for resolution requiring penske leasing truck to remove hazardous waste. I move we approve the resolutio.

>> we discussed number 1 and I think we got a stratstrategy that will enable us to get that done and hopefully present a formal document for the Commissioners court's approval at next Tuesday's meeting. And that will be July 31. Okay. Otherwise no further action. Number 43, I move that we, pursuant to the request from legal counsel, reimburse the purchaser of this property, the entire amount that he paid Travis County, and since we never gave him the deed, turn around and we deed --redeed the property in question to the city of Austin.

>> and that we authorize the county judge to sign the document that legal counsel has prepared for us. Motion includes all of that. Second does too? Discussion? All in favor. That passes by unanimous vote. Number 44 is the matter involving jennifer maldonado, former employee in slot number 45. The matter just went to mediation I move that we approve the compromise settlement agreement, the release of all claims, and indemnity agreement, supplemental to the mediated agreement and all the other language that any good lawyer would put in this document.

>> if the court would authorize the auditory release the funds, that would be helpful.
>> not only do we authorize the auditor to release the fund, you want us to request that the auditory make payment expeditiously.

>> I will use my great influence with the auditor to get that done quickly that is part of the motion? We didn't vote, did we? All in favor. Show Commissioners Davis, eckhardt, dougherty and yours truly voting in favor.

>> abstaining, Commissioner Gomez. In my view, no action required on item number 45. Is that right?

>> all in favor. That passes by unanimous vote. We do have the resolution prepared.
>> the one item that was left, we'll just carry that over to the next session, interest governmental affairs.
