>>41 is to consider and take appropriate action on a memorandum of an understanding between Travis County adult probation and the Travis County sheriff's office to provide 24 beds to the Travis County correctional complex to be used as supplemental capacity for the smart program good morning.

>> good morning judge.

>> good morning.

>> what is this about? Again?

>> as dr. Nanegey discussed with you at a work session about a month or so ago, one of the requests we have pending with the tex as department of criminal justice is to the expand our substance the abuse treatment capacity in delvale, we are having to resubmit document to the state on August 6. Part of that documentation we want to include the mou referenced before you as an interim step to construction that will be built either on property the department currently owns, quasy owns, through lease purchase we're involved in, or pretty immediately add adjacent to the existing smart facility opened by t warren investmentsment we'll be doing a rfp solicitation to identify a developer to do a design build on one of those two properties. However, in order to access the state funding, we need to show good faith in the sense that we need to have operational beds beginning at the beginning of the fiscal year which starts with the state September 1. So we have been in conversation with the sheriff's office to use a portion of one of their buildings in order to accomplish that.

>> and the sheriff has agreed.

>> yes.

>> and the state's position is if you have the beds, we'll give you money to operate them.

>> yes.

>> if you don't have the beds, you don't get the money.

>> exactly.

>> made sense last time and makes sense today questions?

>> let me ask a question.

>> okay.

>> so david, if somebody said you're going to, you have the likelihood of sending people out of county would this be a place where people would stay if we got to a spot where we were having to send people out of county?

>> no, sir, these 24 individuals are already in the bed somewhere on our complex. We are just going to take them out of where they are now and put them in a position where they can start their treatment that much quicker.

>> good.

>> I think that is the key, treatment.

>> yes, ma'am. We're trying to help.

>> how long is that waiting list again?

>> it varies. It can be anywhere from eight week to 20 weeks.

>> how long is it today?

>> I'd have to check. I don't know how long it is today.

>> move approval anyway.

>> second.

>> e-mail me that answer.

>> okay.

>> a rest didn't may want to know.

>> okay.

>> all in favor. That passes by unanimous vote.

>> thank you very much.

>> thank all very much.
