28 we will get legal advice on, let's call it up, maybe we will get to it maybe not. 29. Consider and take appropriate action on the expansion application and related documentation of bfi-allied waste filed with the Texas commission on environmental quality. Consultation with attorney. The goal there is -- is deadline enforceability and various option that's we threw out. 30. Consider and take appropriate action on a counter offer for the sale of land (parcel #12) needed for right of way in the 2005 bond program, howard lane east (i) roadway improvement project, located in precinct 1. Consultation with attorney and real property exceptions to the open meetings act. 31. Consider and take appropriate action on purchase contract and short term lease with the walter and aletha snowden family trust, walter l. Snowden, trustee, and aletha m. Snowden, trustee for the acquisition of approximately 53.944 acres of land in connection with the balcones canyonlands conservation plan. That's the real property exception to the open meetings act. 32. Consider and take appropriate action in relation to star flight operations regarding: a, interpretation of exception for pilots from Travis County personnel policy procedures, section 10.043 holidays; and b, practices represented to payment of on-call services. A and b are under consultation with attorney. 33. Consider and take appropriate action regarding potential purchase of property on lavaca street in central Austin. Consultation with attorney and real estate. 34. Consider and take appropriate action on a plat for recording in precinct three: the vistas at pedernales canyon trail, a revised plat of lot 13 pedernales canyon ranch phase 2. 11 total lots. Consultation with attorney. 35. Receive briefing from county attorney and take appropriate action in claim by jennifer maldonado, former slot #45; eeoc charge no. 31c-2007-00733. Consultation with attorney. And number 36. Receive briefing from county attorney and take appropriate action to accept, reject or counter offer settlement demand regarding arlene tillman eeoc charge no. 451-2007-00612. Consultation with attorney. We will discuss these matters in executive session but will return to open court before we take any action.


We have returned from executive session where we discussed the following items. We did discuss item 28, we will have it back on next week for more discussion and action. That's the executive manager of justice and public safety. And that's July 3rd of 2007. We did not announce or discuss item 29. Item 30, the matter involving the parcel 12 for the howard lane east roadway improvement project. I move that reject the counter offer of $150,000 and make a final offer of the appraised value.

Number 31 involves the snowden family trust property that is offered in the total acreage of 53.944 for the balcones canyonland preserves -- plan, move that we approve the proposed purchase contract and that we approve a lease agreement through August 31st in the amount of $800. That we authorize joe gieselman to sign the appropriate legal documents at closing.

We need the appropriate persons here, we will have it back on the court's agenda July 10th in two weeks. 32 a and b which involves the star flight holiday and on call services compensation. 33 we did discuss. >> okay. 34, involving the advice vistast pedernales. We promised several residents and the applicant that we would have it back on next week. Let's do so. Hopefully get as much work done for an appropriate agreement and disposition for July 3rd. Any other action required today? Okay. 35 the matter involving jennifer mall did a in addition do, maldanodo, move that we reject the offer to settle from her attorney. Discussion? All in favor? That passes by unanimous vote. Number 36 is the matter regarding the charge of arlene tillman that went to mediation in early may or June, I move that we reject the offer to settle which we received from her attorney. Discussion? All in favor? That passes by unanimous vote. And -- and in my view that does it for today. Next week we will have on the agenda the matter involving our current contract by the medical examiner's office because it is uniquely worded. We have planned to sell that property and use the proceeds for the purchase price of a new one. We made several commitments in our negotiations with brackenridge and the city of Austin to acquire the use of that property and so -- so that's kin of a different contract. That's all of it for today.
