Executive Session

Ms. Porter that gets us to executive session, doesn't it web we have postponed item no. 38, we will not call it up.

Receive briefing from county attorney and take appropriate action in claim by jennifer maldonado, former slot #45; eeoc charge no. 31c-2007-00733. This is under consultation with attorney and personnel matters and there is new backup. That court members have been provided. That we will need to take into executive session. 39. Receive update and take appropriate action on selection of executive manager of justice and public safety. Consultation with attorney and personnel matters exceptions. And number 40. Receive legal briefing and take appropriate action on the expansion application and related documentation of bfi-allied waste filed with the Texas commission on environmental quality. That's the consultation with attorney exception to the open meetings act. We will discuss these three items in executive session but will return to open court before taking any action.


we have returned from executive session. By the way, Commissioner eckhardt had to run to another commitment and left about 30 minutes or so ago and will not be with us for the rest of the meeting dñm. We discussed the items that we announced and that was, I think about three, beginning with number 36, we did not discuss, we actually postponed that item until next week. Did not announce and did not discuss. It will be back on may 29. 37 we discussed and that I involved the former employee jennifer maldonado and the e eeoc charge. Let me try a motion. I need to alert the court that my thinking on this is you don't spend 175 when you can spend 250. The motion proposed for us by the county attorney is I move that the court authorize the law firm of, my motion is cold and powell conduct an investigation of the claims raised by jennifer maldonado in consultation with the county attorney's office, and that the court direct the law firm to present through the county judge and authorize him to sign an engagement letter containing the terms of engagement. The fee for professional services shall be paid out of risk management fund and shall not exceed a total of $10,000 without approval from the Commissioners court court. So the intention here is that they come black to us when we reach the amount of 10,000, if ever.

>> seconded by Commissioner Daugherty. Discussion? This is for cole and powell. All in favor of the motion. So Commissioners dougherty, Davis and yours truly voting in favor. Commissioner Gomez abstain abstaining. We did not discuss number 38 38. That will be back on next week unless I am advised otherwise by executive manager. We briefly study number 39. We will have that back on the court's agenda next week week. Hopefully fine-tune or enhance the job posting that we have used in the past and try to come up with an additional one that we can use for an additional search for an appropriate executive manager of justice and public safety, and no other action required today on that one. We study number 40 which involved bfi-allied wastelve we now have two options for a letter to submit to the tc tceq in response to the bfi-allied waste, and we study process and procedure more than the content of those two letters. We learned that we have until mid June, or specifically June 18, to get the comments filed. So next week we will approve a draft letter for public distribution and have it back on the court's agenda on June 5 for final action and give ourselves an additional week or so in the event that we are not ready on June 5. The key point is we will have it back on the court's agenda on may 29 to approve a draft for public distribution and comments, and then have comments back for court consideration the first Tuesday in June anything further on number 40 ?
