1. Receive comments regarding a request to authorize the filing of an instrument to vacate a portion of anderson mill road right of way and to approve a license agreement with the estates of brentwood homeowners association in precinct 3.

>> good morning, joe gieselman with the transportation natural resources department. We had brought this topic to the Commissioners court several weeks back. It's part of a capital improvements program on anderson mill road. The county is widening the road to an arterial section and the -- the retaining wall of the roadway is about one foot away from the privacy fence of the individual properties. So it leaves about a little more than a foot gap between -- in the fence is on the edge of the right-of-way. So what we have is a retaining wall, a sliver of public right-of-way and then the retaining fence. And -- and these -- seems like the easiest way to remedy the situation is to vacate the -- the right-of-way for that one foot and allow the property openers then to -- to attach their retaining wall, fence to the retaining wall. We would have one line that -- that becomes the demarcation line for what's public and what's private. There's also a large oak tree that extends out into the right-of-way and the homeowners association would prefer that tree be preserved and they are willing to pick up the ongoing maintenance responsibility of that tree through a license agreement. So today's action public hearing is regarding the basically the vacation of that small sliver of right-of-way as well as entering into a licensing agreement with the -- with the homeowners association for the maintenance of the tree. I believe all of the -- the affected property owners have been notified. I know of no objection, but -- but the purpose of the public hearing is to find out if there is any public comment on this proposed action. Three. (Commissioner

>> these -- this actually will take place today. The contract -- somebody -- I don't see them here. I will get that information. A number of months. We are under contract right now --

>> are we talking about the whole project or just this part? The whole project.

>> I don't think we are -- we are supposed to be finished with that until probably the -- the spring of '08, joe. That's the last --

>> it's under contract. I just need to find out exactly what day the contractor is supposed to be finished with it. I can get you that information.

>> joe, you might want to explain. One of the things that's held us up is we've had some utility issues on the road. I do think that we have somewhat resolved them and we are moving forward. So we may be able to get this thing done, you know, faster with any luck at all, you know, we might be able to get it done by the end of the year. But nobody wants to finish it faster than we do. So --

>> I don't know. Do you live out there?

>> no. I'm just on this end of the phone call.

>> [laughter] so I think we both share, you know, the frustration that we have with that.

>> right. We live on a cul de sac, we have one way in, one way out. And it's playing chicken to get in and out.

>> you know whenever you are doing these infrastructure deals like roads and these things, they are never easy. Everybody likes them once it gets finished. But, you know, during the interim is really tough. So -- but we will -- you know, we are going to work on that as fast as we can.
