Executive Session

That brings us to executive session. Let me just indicate that I got from judge aleshire a request to postpone one item. And what I suggest we do is have the issue laid out today, because it may get a little complicated, then have it back on next week for action. That item is the --

>> number 38. Sure is. Sent the whole court that, right?

>> so on 38 we will postpone action until next week to give him a chance to get here. And next week is the 24th. That's on 38. And what we need to do, get from staff, is really just the issue laid out. It's a fairly long executive session today, but we have a lot of resale deeds. Beginning with number 33. 33. Consider and take appropriate action on a second offer to sell Travis County a 0.083 acre (3,604 where sq. Ft.) Parcel of land needed for use as right of way in construction of the gattis school road improvement project as part of the 2005 bond program. Consultation with attorney and that's the real property exception to the open meetings act. 34. Consider and take appropriate action on an offer to sell Travis County a 0.043 acre (1,873 sq. Ft.) Parcel of land and a 0.014 acre (618 sq. Ft.) Parcel of land for use as right of way in construction of the gattis school road improvement project as part of the 2005 bond program. Consultation with attorney and real property exception to the open meetings act. 35. Consider and take appropriate action on an offer to sell Travis County a 0.111 acre (4,834 sq. Ft.) Parcel of land for use as right of way in construction of the gattis school road improvement project as part of the 2005 bond program. Consultation with attorney and real property exceptions to the open meetings act. 36. Receive update and discuss personnel issues regarding appointment of Travis County fire marshal. Personnel matters exception. 37. Receive briefing from the county attorney and take appropriate action in Travis County, et al v. Nrc, inc. (jose alfredo valles resale deed. ] consultation with attorney.

>> may I ask a question. On the previous one, number 36, can you recall last week were there any legal issues that you needed advice on as well? Is that --

>> well, I tell you what, last weekend it was all personnel, let's just announce under consultation with attorney as well as personnel, can we do that.

>> 36, we will do both of them just in case. 38 we will not take action today but we will discuss in executive session to identify issues in preparation for next week, that's to receive briefing from the county attorney and take appropriate action in Travis County, et al v. Consultation with attorney exception. 42. Receive briefing from the county attorney and take appropriate action in Travis County, et al v. Larry w. Phillips (christopher and kristina wynn resale deed). Consultation with attorney. 43. Receive briefing from the county attorney and take appropriate action regarding that certain request by landmark surveying, lp for -- that certain request by landmark surveying, lp for right of entry authorization on Travis County land. Consultation with attorney, let's add, and real estate exceptions to the open meetings act.

Nope. 45 is to receive briefing from county attorney and take appropriate action concerning the extension of administrative leave with pay for Travis County sheriff's office employee, slot 1694. Consultation with attorney and personnel matters exceptions to the open meetings act. And -- and number 46. Receive briefing from county attorney and take appropriate action concerning the extension of administrative leave with pay for Travis County juvenile probation department employee, slot 412. Consultation with attorney and personnel matters exceptions to the open meetings act. We will discuss these matters in executive session.

>> okay. Let's do add 30 e. Which I have overlooked, thank you all. That is the matter involving senate concurrent resolution 42, granting guerrero-mcdonald and guerrero-mcdonald & associates, inc., permission to sue Travis County; that will be posted under the consultation with attorney under the open meetings act. We will discuss all of these announced items in executive session. But will return to open court before taking any action.


we have returned from executive session where we discussed the following item. 30-e we got our legal questions answered. No action required today. Move that we indicate our opposition to this resolution. Discussion? All in favor? That passes by unanimous vote. Number 33 involves .083 acres parcel of land that we need for the gattis school road improvement project. The property owner is the kaufman, mr. Kaufman. I move that we accept the third offer to settle this matter in the amount of $21,624 with the owner being responsible for all improvements.

>> discussion? All in favor that passes by unanimous vote. Number 34, I move that the Travis County countered the offer we've received from the property owner, the cisneros family in the amount of $13,050, which would include all costs associated with the improvements. So that would be a counteroffer from Travis County. Discussion? All in favor? That passes by unanimous vote. Number 35, I move that Travis County reject the offer to settle and that we counter that offer request the troaj settle for the amount of 18,001 fwift dollars with the county to relocate or replace the existing fence.

>> discussion? All in favor? That passes by unanimous vote. Number 36 involves the appointment of Travis County fire marshal and the discussion that we had and various actions taken to fill this position. I move that we indicate our intention to interview the acting fire marshal as soon as possible, give ourselves maybe next week an opportunity to take 45 minutes or so for that interview. And what's his full name, brad beachham?

>> mr. Brad beach dloop ma'am is owe o. -- beach ham is the acting fire marshal right now. Discussion? All in favor? That passes by unanimous vote. You will let him know that and maybe we'll try to leave room at the end of our session. Number 37 involves the proposed tax resale deed from Travis County to jose alfred dough velles, who has paid Travis County the sum of $5,550 in cash.

>> discussion? All in favor? That passes by unanimous vote. We did discuss number 38 with legal counsel, but consistent with our prediscussion commitment, we will take no action today, but will have that item back on the court's agenda for appropriate action next week.

>> number 39, move that we authorize the county judge to sign the prepared tax resale deed to richard waliswalicke junior, who has paid Travis County the sum of $5,000.

>> discussion? All in favor? That passes by unanimous vote. Next item is number 40. I move that we authorize the county judge to sign the prepared tax resale deed to the city of Jonestown, Texas, which has paid Travis County the sum of $5,000 in cash.

>> 5700?

>> no. It's number 40.

>> number 40 is $5,000, that's a breakdown where we get two thousand and Leander gets three thousand?

>> the deed is $5,000 in cash. What the allocation is after that normally we just --

>> you don't have to say the allocation?

>> after that there's a breakdown on how it goes. So $5,000 in cash, which we have received from the city of Jonestown already. Discussion? All in favor? That passes by unanimous vote. That was 40. Next is 41.

Number 43, I move that we approve the request for authorization for right of entry on to this county owned property. In exchange for a release of liability which I understand has already been signed. Discussion? All in favor? That passes by unanimous vote. 44 I move that we approve the request for a one month extension, that's for us, with a payment to be made to our landlord.

>> all in favor? That passes by unanimous vote. Number 45 I move that we approve the request for an extension administrative leave with pay for an additional five days for the employee in the sheriff's office slot 1694.

On number 46, I move that we authorize the request for an extension of administrative leave with pay for Travis County -- for employee in slot number 412. In the Travis County juvenile probation department, this is a 15-day of additional leave with pay.
