26 is to consider and take appropriate action on request for clarification on court's decision regarding whether to retain the by bond or return it to boretex llc at the time of contract award. We did award this contract two weeks ago, I guess, nand the backup, though, there was a notation regarding the bond which we did not openly address in court. So that matter was left unaddressed. And the recommendation from cyd's shop is...

>> to return the bid bond to the contractor.

>> moveat's appropriate because there's no good reason for us to keep it, right?

>> well, the purpose of the bid bond is to make sure that puke who are bidding on our projects -- that people who are bidding on our projects are responsible and qualified to do the work. And so that discourages folks from just throwing their hat in and trying to see if they get it or not and then pulling out when they don't. In this particular case they just made an error in their bid and they could not do the work at that low bid price, so instead of retaining the bond, it's about $35,000, we would recommend return ing it to them.
