Executive Session

Now, we indicated earlier that we would take the item involving temporary employees, number 9, into executive session too after consultation with attorney, under the consultation with attorney exception to the open meeting act. So we will do that, 9 a, b and c dealing with how we treat temporary employees and what the law requires. Month month--in my view we do not need the item involving jail con strug at dell vail, do we, number 39, since we approved the contract. But we do need 34. And that is to consider and take appropriate action on an offer to sell to Travis County 0.124 acre, 5,401 square feet, of land located on gattis school road in precinct two required for construction of the school roadway improvement project, 2005 bond program. That's under the the real property and consultation with attorneys open meeting act. 35, consider and take appropriate action on an offer to sell to Travis County 2.243 acres of land located on par sons street, old highway 20 in precinct one, bridge number 133 replacement project, 2001 bond program. Consultation with attorney and real property exceptions to the open meetings act. Number 36, receive briefing from county attorney and take appropriate action on entertainment by j and j ink versus perez, govea, and like mercer, constable precinct one, et al, consultation with attorney open meeting act. 37, receive briefing and take appropriate action on generally liability claim by ophelia milicia for water damage to residence. Consultation with attorney. And number 38, receive brief briefing from county attorney and take appropriate action on attorney generally's opinion regarding release of records to the public, including social security numbers. Consultation with attorney exception to the open meetings act. We'll discuss these matters in executive session and return to open court before taking any action.


...items dealing with certain temporary employees and the new law. We will have it back on the court's agenda next week. In my view, no action required today but we did get a much better an understanding of the legal standards that come into play. And that's March 13, next Tuesday, we will address those issues again. Number 34 involves the gatti gattis school road project and the 0.12 acres of land, move that we accept the offer to sell this land to Travis County for the school road improvement project for the sum of $26,000.

>> second by Commissioner Gomez. All in favor? That passes by unanimous vote. 36 involves the claim by j and j, entertain am by j and j, inc., versus perez, govi govian and mercer. We did check with the county attorney and ask them to talk with other side about trying to resolve the matter matter. We'll have it back on the court's agenda March 13 for follow-up with appropriate action. We actually authorized county attorney to settle for, an offer to settle for 40 percent of the total amount of this judgment, and so we would expect follow-up action next week. Think we ought to move that. Move those, that the county attorney carry out, be authorized to carry out those directions.

That passes by unanimous vote. 37 involves the generally liability claim of ophelia m milicia, and move that we authorize settlement of this matter with the county payings 64,031, other specific terms and conditions as set forth in the proposed release and settlement agreement. Also move that we direct all caps, underlined, the county attorney to initiate litigation in this matter on behalf of Travis County as soon as possible.

>> working in conjunction with the other side. Discussion? All in favor. That passes by unanimous vote. 38 involves the ag recent opinion regarding the release of social security numbers. We also discussed legally exactly what that enfails-- enfails--entails and other actions taken by the legislature. Probably no action required by us other than to keep it on the radar. It will be on agenda in the future. We did not discussion 39 because we agreed to eye ward the contract. Anything else today ?
