25. Consider and take appropriate action on the following: a, fy '06 employee health benefits fund annual report; and b. Fy '07 employee health benefits fund 1st quarterly report.

>> good morning, alicia perez, executive manager for administrative operations. I have here also staff

>> [indiscernible] our benefits director and

>> [indiscernible] who does the financials on health care. Budget. We presented last week the annual fy '06 health care fund report to the court and we have before you the first quarter of fy '07. We provided the court copies of that last week. We could go through -- we presented last week the annual report for fy '06. If you would like we can go through the quarterly report or if you have any questions we can answer those, too. We would like approval on the reports and like I said it's your pleasure whether you want us to go through the quarterly report.

>> is there anything in the quarterly report that's especially noteworthy?

>> I would point out -- no. I would point out just a couple of things as we do all the time on these particular reports. Is that your health care fund, your reserve, is at about 25 million, that can be found in your backup on page 8.

>> I would just caution that being the first quarter of the plan year, not to draw too many financial conclusions, but that it's still looking good.

>> we have one claimant that has exceeded the $150,000 limit and nine that could exceed the 50,000. Which we had 19 last year, 19. So we are probably going to see about that number in terms of high cost claims.

>> we know there's several more high claimants in the pipeline, this is through the first quarter which is December. We are already into February, we have seen a couple more actually exceed. That will come to you in the next quarterly report.

>> effectively our first quarter we increased a couple million.

>> yes, sir. It hasn't been remarkable in the amount.

>> right.

>> > the annual report is what we received last Thursday.

>> move approval of 25 a.

>> second.

>> discussion? All in favor? That passes by unanimous vote. With Commissioner Eckhardt temporarily off the dais. And b is the quarterly report that apparently has no highlights that has no -- no.

>> I think we provided you all of the information.

>> pretty routine.

>> pretty routine. What we would like for the court also to approve is these health care issues for fy '08. We submit --

>> are those posted.

>> well -- no. I guess as part of the report. But we can repost them.

>> part of the quarterly report?

>> part of the quarterly report just discussion on health care issues, judge, that's how it's related.

>> let's have a specific posting on that. You are not trying to avoid a discussion with the court, are you?

>>

>> [laughter]

>> > not at all.

>> let me ask, judge, when we had this discussion, the way I read this, are we still -- we haven't determined in other words whether we are going to do the epo or not. That still is -- up for discussion.

>> correct.

>> because I know --

>> what I was suggesting is that we post specifically.

>> okay.

>> and the motion really enables us to approve the report and we are pretty much approving the filing of the report and acknowledging our receipt of it, et cetera.

>> yes.

>> no specific action other than that attaches to it.

>> that's correct.

>> second.

>> your honor, may I make -- may be on the record of voting in favor of that.

>> of a?

>> yes.

>> okay. Let the record show that Commissioner Eckhardt has returned to the dais and votes in favor of 25 a.

>> too much coffee this morning.

>> I'm going to have to really start getting used to, you know, your honor, but I know that from an attorney that's --

>> [laughter]

>> I'm trying to get used to it myself.

>> for four years I've been calling you the wrong thing.

>> we will all have to practice that, yes, sir, your honor.

>> any more discussion of the motion to approve 25 b? All in favor? That passes by unanimous vote. Okay.
