I believe that brings us to executive session, doesn't it? Don't look so surprised when I ask that question, ms. Porter?

>> there's still time for us to get bogged down. The county attorney has asked us to postpone item number 25. That leaves us with the following three item, number 24, receive briefing from county attorney and take appropriate, regarding lone star productions event scheduled may 30th through June 3, 2007. This is under consultation with attorney exception to the open meetings act. 25 we postponed. 26, receive briefing from county attorney and take appropriate, on contract negotiations with faulkner u.s.a. For new jail construction at del valle correctional complex, design-build project. Consultation with attorney. John, we were sent an e-mail this morning about faulkner, right?

>> I remember seeing that, but do not have any copy. I don't know whether we need that with us? Somebody needs to bring extra copies. It's just two pages, right?

>> and the last item for executive session discussion is 27, receive legal briefing from county attorney and take appropriate, on general liability claim by ophelia malicia for water damage to residence at 1405 canterbury, Austin, Texas. That will be consultation with attorney exception to the open meetings act also. We will discuss these matters in executive session, but will return to open court before taking any action.


...i guess hopefully by next week we can toin have this on the agenda to see what kind of response we're getting from that request.

>> and staff did indicate basically a need to do further reen on some of the -- further research on some of the county ordinances that may come into play. So if it looks like they do not, then we can call it to their attention.

we did not discuss 25 that was pulled by the county attorney.
26 we did discuss and that involves the faulkner u.s.a. Proposal to construct the new jail project at del valle. Got advice of counsel, got some questions answered. We'll have it back on next Tuesday. We did ask the county attorney to let us know whether we need a sooner update, and they will let the county judge know tomorrow whether it's visible to put this matter -- whether it's advisable to put this matter on for Tuesday -- for Monday where this would be the sole item if we need to discuss it before the deadline of Tuesday, February 13 its. So we'll hopefully make that decision by noon tomorrow and have it on early afternoon. Otherwise I don't think there's any other, to take today, right? I do think we're making progress and hopefully we'll have this matter resolved next week and have a contract executed. Okay?
item number 27, which involves the general liability claim by ophelia malacia, move that we authorize county staff to allocate $59,029 from the risk fund in order to cover construction costs on this project, and that we authorize the facilities department of Travis County to oversee construction and that we give notice to the insurance company either by letter or immediate lawsuit of the need to spend an additional approximately $60,000 to the amount that we last gave them notice of.
