3. Approve termination of contract no. 06k00274lp with gg's construction for. Sidewalk maintenance program and provide direction regarding. Contractor's bid securit

>> good morning, cyd grimes, purchasing agent. We awarded a contract or you awarded the Commissioners court awarded a contract on August the 29th with gg's construction in the amount of 191,358. This is for the t.n.r. Sidewalk maintenance program. They were unable to approve the required bonding, some of the reasons that they gave in their letter to us was that -- that they were a small company. They had only been in business for 16 months. And there was a -- almost a $250,000 difference between their bid and the next lowest bidder which gave their bonding company some concern that perhaps they did underbid this project. This -- this was the second -- we bid this project once and we got no bids. This was the seconds time we bid it. And the issue today for the court to decide is whether we will retain their bid security in the amount of $9,567 and 90 cents,

>> so did their bid come in close to our -- our budgeted range?

>> it did. It did come into our range.

>> but it was 200 -- less than the second bid?

>> correct.

>> which I believe the next bidder was over our budget.

>> move approval of the -- of the request to terminate.

>> quick question, judge. Does that include a decision about what do we do with the --

>> no.

>> okay. Not a problem.

>> okay.

>> just to material nate the contract.

>> yeah.

>> all in favor? That passes by unanimous vote. Now, as to the -- bid security, this does not come up every day.

>> no.

>> but when it has come up, what have we done?

>> we have not kept their bid sureties.

>> we think really generally tried to get the bid bond to do the contract --

>> yeah, my office -- my office worked -- we contacted u.t., they have a bonding program, we contacted the city of Austin. We contacted the mentor protege program and we also called the bonding company to try to -- to get -- to help them out. But --

>> what was that amount?

>> the bond, the bid security was 9,567.90.

>> I move approval of that -- that we return that amount to gg construction. For the sidewalk project.

>> second.

>> discussion?

>> that's 100% basically?

>> yes.

>> all in favor? That passes by unanimous vote.

>> thank you.

>> thank you.

>> how are we going to proceed from here? Are we going to go back out. Clearly the number two bid was not even close.

>> I think t.n.r. Is looking at additional moneys to fund the project.

>> okay.

>> I think it's just a day of coincidence that we've had the sidewalk issue and -- and project budgets.

>> potentially one that if you split it up geographically, we might get more interest because certainly if you have got a county-wide program, it's kind of like what we do on some of our paving things, that we wind up doing it per precinct or at least eastside versus west side.

>> I'm not sure how -- if we did it by line item or a lump sum.

>> it was a lump --

>> precinct.

>> okay.

>> so there's a possibility we could like we do on our substandard loan project, by precinct or award by precinct.

>> certainly there's a difference in geography and also soil conditions.

>> sometimes just timing with other entities doing bidding. So much road work and concrete work it's just -- just depends.
